Case #3: J~

E. Information Items:

1. Council noted letter dated September 23, 1985 to Paul Ruud, Anoka
County Engineer, frc~ the City Engineer reegarding the flooding proble~ on
County Road #116.

2. Council noted letter dated September 23, 1985 frc~ City Engineer
regarding the flooding of 149th Avenue N.W. in Pineview Estates.

3. Council noted list of high water or flooding problems prepared by the
City Engineer.

Mrs. Peterson of 7351 151st Avenue, Mrs. Bancroft of 7431 151st Avenue and
Jim Battenberg 7471 150th Lane were present.

Mrs. Peterson stated that the E~R controlled ponding area is flooding her
hc~e and inquired as to what gives E~R the right to do this to her
property.

Mr. Battenberg stated that there will be a wajor flooding problem in the
Spring of 1986. Mr. Batenberg stated that he doesn't want to see the pond
disappear but DNR should put in a gate and pu~p the excess water to the
river; a solution is expensive and will not pay to solve the problem in
view of the fact that DNR claims jurisdiction to half of his property by
encroaching wetlands and he must pay the property taxes. Mr. Battenberg
noted that there are 4 lots on 149th that are in the DNR wetlands that are
considered buildable lots by the City of Ramsey.

Councilmerber Cox stated that installing storm sewer requires that all
benefitted property owners be assessed; this assessment could bankrupt
certain properties between this problsm area and the river; this could
result in a failed petition which the Charter says prohibits the project.

Mr. Goodrich stated that the project would be prohibited unless there is a
successful petition by 50% of the registered voters to pay for the project
out of the City's general taxes.

Mayor Heitman stated that a storm sewer project could be paid for by
bonding and this is subject to a referendum vote.

Mr. Battenberg stated that this area is Class II wetlands which means
it is supposed to dry up and it's not; he has been dealing with DNR for
more than two years and by the t/me the probl~ is solved, the hc~es will
be worthless.

Mayor Heitman stated that at this point it seers that all the City can do
is be an advocate on behalf of the affected citizens; there isn't anything
else the City can do other than to put in a storm sewer project that the
City cannot afford.

September 24, 1985
