Agree that the Economic <br />DeveloI~ent C~r~ission and Planning and Zoning should re~iew the requests, with <br />each having certain criteria to address. Mayor Heitwan stated that he feels <br />the policy should also call for some up front funds to cover the legal and <br />financial review costs incurred during the process. Tae policy should also <br />quote an appropriate fee and time schedule and there should be the opportunity <br />for the applicant to discontinue the process if legal and financial reviews <br />become too costly. <br /> <br />Council and Economic Develot~ent Commission proceeded to establish the <br />following policy for processing tax incr~ent financing assistance: <br /> <br />Section 1. City Staff receives the request from the developer and reviews it <br />with respect to the following matters: <br /> <br />1) <br /> <br />Information regarding a complete description of the total project <br />including location and type of develo~ent, total project cost and <br />total full-time, permanent e~ployn~nt created, if applicable. <br /> <br />2) I~formation regarding description of request, including timetable, <br /> specifications and costs estimates. <br /> <br />3) <br /> <br />Financial feasibility through review with City's fiscal consultants. <br />If the request appears to be financially feasible, the fiscal <br />consultants may recommend/suggest possible structure(s) for financing <br />request. <br /> <br />4) <br /> <br />Legal feasibility through review by City's bond counsel. If request <br />is legally feasible, bond counsel will determine whether documents <br />need to be modified and/or hearing process is necessary. <br /> <br />If the request is legally and financially feasible, Staff will forward its <br />findings (including those of bond counsel and fiscal consultants) to the <br />Planning and Zoning and Economic Develol~ent Commissions for their review and <br />recomwen~tions. <br /> <br />(Council requested that Ms. Norris incorporate into the above section that the <br />applicant be provided with a fee and time schedule and a provision for the <br />applicant to withdraw his request if the preliminary reviews indicate that fees <br />and times will too greatly exceed the norm quoted in the schedules. ) <br /> <br />(Council also directed Ms. Norris to incorporate into the above Section I a <br />'determination of need' consideration similar to that found in Anoka's policy.) <br /> <br />Section 2.
