Mr. Goodrich stated that the develoI~rent moratorium has been lifted and <br />Council's agenda for November 12 will include a request frc~ Waste Management <br />of Minnesota, Inc. for a conditional use permit for excavation. <br /> <br />Case #5: 1~ <br /> <br />A. City Attorney's Report To Council On Investigation: <br /> <br />Mr. Goodrich stated that a member of his firm has met with Councilwember COx <br />regarding former Building Official Berg's outside activities while ~rployed by <br />the City of Rawsey; this project has not been completed. <br /> <br />B. Miscellaneous Legal Issues: <br /> <br />Mr. Goodrich stated that the results of the Eason hearing have been received <br />from the Unemployment Division; Ramsey's appeal has ben denied and Mr. Eason <br />was granted unemployment compensation. Mr. Goodrich recommended that Council <br />waive Ramsey's right to appeal that decision. <br /> <br />Motion by Mayor Heitman and seconded by Councilme~rber Reimann authorizing the <br />waiving of Rawsey's right to appeal the decision of the Unemployment Division <br />in the case of former Police Officer Eason. <br /> <br />Further Discussion: Mr. Goodrich stated that he will pursue the issue from the <br />standpoint that it did come out in testimony that Mr. Eason was not unemployed, <br />but rather self-employed, immediately after he terminated employment with <br />Rawsey and some of Mr. Eason's own unemployment benefits should be utilized. <br />Councilmember COx stated that it was Mr. Eason's own actions and private life <br />issues that generated his on-th-job problems and eventual resignation. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilwe~bers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Mr. Goodrich noted for Council's information that City Engineer Raatikka has <br />had an irguiry from a law firm regarding Ramsey's drainage plans for 151st and <br />Rhinestone. <br /> <br />Mr. Goodrich stated that he needs Council authorization for two private <br />sessions of the Personnel Committee for the purpose of discussing the AFSCME <br />contr act. <br /> <br />Motion by Councilmember COx and seconded by Mayor Heitman authorizing the <br />scheduling of two closed Personnel Committee meetings, in accordance with the <br />Open Meeting Law, for October 25 at 8:00 a.m. and October 31 at 8:00 a.m. <br /> <br />Further DiScussion: Mr. Goodrich stated that on October 25 the Personnel <br />Committee will also conduct a regular meeting at 9:00 a.m. CouncilFe~ber Cox <br />inquired if Councilmembers Reimann and Sorteberg are able to attend a day-time <br />meeting. Councilme~ber Reimann replied that it will mean a couple of hours <br />less pay from his regular job but it has to be done. <br /> <br />Motion carried.
