No Certificate. of Occupancy permit shall be issued for any house in the plat until <br />the following have been completed: <br />A. An as -built plan of the development and a letter from the Developer's engineer <br />certifying the plat has been graded according to. the grading, drainage and <br />erosion cdntrol plan as approved by the City. The Developer will notify the City <br />a minimurn of two (2) weeks prior to any Certificate of Occupancy permit being <br />issued. <br />B. Removaiiireatment of all dead, dying or diseased trees, as determined by City's <br />Natural Resources Technician, from the property at the Developerrs expense or <br />escrow fo - any remaining trees that will need to be removed. Stockpiling the <br />dead tree.; on the lot for resident's removal for firewood will be acceptable only. <br />after the lot has been graded to plan. <br />G. The first l.ft of street asphalt surface, sanitary sewer, storm sewer and water <br />main, has been constructed, considered operational, and approved by the City <br />Engineer. The Developer will notify the City a minimum of two (2) weeks prior to <br />any Certificate of Occupancy permit being requested to allow adequate time for <br />an inspelort to be completed daft the required improvements_ <br />The Developer further agrees that thwwill not cause to be occupied, any premises <br />constructed upon the plat or any property within .the Wet until the completion of the 'gas, <br />electric, telephone, cable television (if available), streets to asphalt surface, sanitary sewer, <br />storm sewer and water main, unless the City has agreed in writing to waive this <br />requirement as to a ipectic premises. <br />Seeding and sodding of the lot shall be. completed as specified by City Code #9, <br />Chapter 10. In the vent a lot is not seeded or sodded and does not have the 4 inches of <br />black/organic dirt s read prior to issuance of a Certificate of Occupancy, the builder shall <br />post a$2,500 cash scrow to assure that the lot will have black dirt and a lawn established <br />within six months. _scrowing prior to issuance of the Certificate of Occupancishall also <br />be required for all otier.incompiete items. <br />The City Buif.ling Official will issue a stop work order for any violations relating to silt <br />fencing, erosion cotlrol and tree protection. <br />ARTICLE SEVEN <br />CLEANUP" <br />Developer shall promptly clean dirt and debris from streets that has resulted from <br />construction by the Developer, its agents or assigns: Performance shall be guaranteed by <br />. . <br />the financial guarantee recited herein.
