Request for a temporary conditional use permit for mining; case of <br /> Waste Management of Minnesota, Inc. <br /> <br />~he public hearing adjourned at 9:00 p.m. and Council recessed. <br /> <br />Mayor Heitman called the regular meeting back to order at 9:18 p.m. <br /> <br />COUNCIL BUSINESS <br /> <br />~ Reoues~ For_A TemporarY_ Conditional_Use__Permit~ Foz_Minina:_ <br /> ''Cave,Of waS.~'M~n~a~men~ Of_Mirinesota,'Inc..: <br /> <br />Councilmember Reimann requested that City Attorney Goodrich explain Minnesota <br />Statute 473.806. <br /> <br />Mr. Goodrich stated that in the siting process in the Waste Management Act of <br />1980, legislature set up a program whereby any site designated, although not <br />chosen, and the area within that site, as well as required buffer area, shall <br />not be developed; this allows for preserving of property within designated <br />landfill inventory, including Site P, for potential use as a landfill. ~his <br />mining permit request before the City will require Metro Council and County <br />permits for that use because of the moratorium. If the City were to grant <br />this mining permit, it is 100% contingent upon the applicant receiving <br />approval from Metro Council and the County for this development. Development <br />would mean any change in land use from what exists there now. <br /> <br />Councilmember Schlueter inquired if the issuance of this permit is absolutely <br />essential to complete the capacity of the existing landfill. <br /> <br />Mr. Edward Moersfelder replied that he doesn't know. Completing capacity <br />at the existing landfill is not the total picture; the operation does not <br />cease when the last dumping is made at the site. The future of the landfill <br />is determined by factors that Waste Management of Minnesota, Inc. does not <br />have control over. ~he site may be closed without anything more being done to <br />it; PCA and County may direct for substantial changes in slope, for instance, <br />that would requiremore filling. <br /> <br />Councilm~mber Schlueter inquired why Waste Management of Minnesota, Inc. did <br />not approach Metro Council and the County regarding lifting the moratorium <br />prior to approaching the City for a mining permit. <br /> <br />Mr. Moersfelder stated that during contract negotiations with Ramsey, Waste <br />Management of Minnesota, Inc. anticipated getting the mining permit and up <br />until the sale closing, Waste Management of Minnesota, Inc. was given to <br />understand that the mining permit would be an administrative matter for <br />Ramsey. Tme mining permit request was placed, by this Council, on the advice <br />of City Attorney Goodrich, into the temporary conditional use category. Waste <br />Management felt it appropriate to pursue the matter with Ramsey; and in <br />fairness to Metro Council, Waste Management of Minnesota, Inc. wanted to be <br />able to tell them that one piece of flapping tarp had been pinned down.
