zone; that the properties developing adjacent to his business will be <br />maintained in a way that would be detrimental to the value of his property. <br /> <br />Mr. Berg stated that heavy industrial use would be allowed in this area and <br />suggested that rather than going with a metes and bounds subdivision, as is <br />also being requested, the developer go with platting and write a restrictive <br />covenance into the deed that would address land use in the adjacent <br />properties. Mr. Berg stated another alternative as during recodification, <br />develop industrial zones with a less intense use. <br /> <br />Mr. Kummala inquired if there are any City ordinances in place that address <br />exterior upkeep and maintenance and stated that he has no further concern if <br />these ordinances are enforced. <br /> <br />Mayor Heitman stated that there are ordinances in place. <br /> <br />Councilmember Reimann stated that the City tries to enforce the ordinance but <br />that is not always a solution. <br /> <br />Mayor Heitman confirmed that the enforcement is less than what Mr. Kummala is <br />expecting. <br /> <br />Mr. Kummala stated that his next facility will be even nicer than the present <br />one; that he doesn't object to even metal buildings be constructed adjacent to <br />his business as long as their grounds are kept up. Mr. Kummala stated that <br />there is no way the owner of the property he intends to buy will agree to <br />restrictive covenance and he is also open for suggestions as to more <br />appropriate property on which to develop his new facility. <br /> <br />Mayor Heitman stated that the ordinances are in place and have not been <br />enforced as well as could be; the City cannot give Mr. Kummala the assurances <br />he would like to have; do not know of alternative areas in which to develop. <br /> <br />Mr. Schnelle suggested an alternative as going to a site and design plan which <br />would involve more government control, which Council has been reluctant to do <br />in an industrial area. <br /> <br />Mr. Ku~mala stated that the City should designate an area for light <br />manufacturing. Mr. Kummala noted that he is not asking the City for any <br />financial assisstance or incentives to develop and questioned why he would <br />want to invest $500,000.00 when the City cannot even aid in protecting the <br />value of his property. <br /> <br />Mr. Berg stated that the City has required a site and design plan in the past <br />and there are several instances on record where the Council allowed variances <br />to the site and design plans. <br /> <br />Councilmember Cox stated that one of the reasons Council has walked away from <br />the site and design plans is because we are trying to compete with surrounding <br />communities that have everything to offer developers. Councilmember Cox <br />stated that if there should be a neighboring property that is in conflict with <br />the City's ordinance, the owner would be notified. <br /> <br />February 12, 1985 <br /> <br />Page 9 of 16 <br /> <br /> <br />
