Motion by (buncilmember Cox and seconded by Mayor Heitman to table this case <br />until Council's regular meeting scheduled for June 25, 1985. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #9: ~equ_ est For Variance From Platting Requ~ irements Of Subdivision <br /> Chapter; Case Of Mr. And Mrs. John Brolsma: <br /> <br />Mrs. Brolsma was present. <br /> <br />Motion by Councilm~mber COx and seconded by Councilmember Sorteberg to approve <br />Mr. and Mrs. Brolsma's request for a variance from the platting requirements of <br />the subdivision chapter with the provision that ordinances do not presently <br />allow for a budlding permit to be issue on that property. <br /> <br />Motion carried. (continued): <br /> <br />City Attorney Goodrich stated that the proposed resolution for preliminary and <br />final plat approval on Northfork should be revised as follows: <br /> <br />Replace language in Item #2.c with: '~hat there be an agreement for the <br />financial responsibility relating to Ramsey's and applicant's share of <br />improvements to Jarvis Street adjacent to the subject plat.' <br /> <br />Add Item %2.e.. 'That the plat may not be filed until the P.U.D. zoning <br />ordinance is effective. That the developer is advised that any on-site <br />improv~ents constructed prior to filing the plat will be made at it's <br />own risk. ' <br /> <br />Councilmember Schlueter recalled that there was some doubt as to the <br />buildability of ~wo of the lots. <br /> <br />Mr. Raatikka stated that one lot will be filled and the lot line of the other <br />lot has been extended in order to provide more buildable soil area. <br /> <br />Councilmember Schlueter inquired as to the status of the City's request for <br />access across Burlington Northern Railroad crossing. <br /> <br />Mr. Schnelle stated that the request for access across Burlington Northern has <br />been withdrawn; with the revised plat there is no need for public access across <br />the crossing. <br /> <br />Councilm~m~er Schlueter noted that the developers will be using the crossing in <br />their marketing process and the crossing is intended to be used in emergency <br />situations. <br /> <br />Mr. Schnelle stated that it will be the developer's responsibility to restrict <br />access; that access will only be opened up to the public in an emergency <br /> June 11, 1985 <br /> <br />Page 9 of 14 <br /> <br /> <br />
