Mr. Merland Otto, consulting engineer for the airport improvement project, <br />was ?resent and stated that the purpose of airport zoning is to protect the <br />public investment in development of an airport, assures the community the <br />option to go ahead with airport improvements and protects airport and <br />aircraft users while protecting people and property. There are two types <br />of zoning: 1) height limitation zoning; 2) land use safety zoning. <br />Typically, airport zoning is accomplished by a joint zoning board <br />representing the affected agencies, which in this case would be Ramsey, <br />Anoka, Champlin, Dayton, Anoka County and Hennepin County. In situations <br />like Ramsey's where the City does not own or control the airport, State <br />statute provides that the individual city can adopt a zoning ordinance and <br />request other affected agencies to adopt similar ordinances. Mr. Otto <br />proceeded to review the proposed airport zoning ordinance, defining the <br />various safety zones, height limitations and land use restrictions. <br /> <br />Mr. Hartley stated that airport zoning timing is a major issue because it <br />could be as much as 1-1/2 years from the time zoning is implemented until <br />Ramsey has authorization to begin property acquisition. The Minnesota <br />Department of Transporation, Aeronautics Division, has indicated that at <br />some point in time the State would help in property acquisition, even <br />before FAA gets involved. Any of the State's advanced participation would <br />be on a 2/3 - 1/3 basis. When FAA funding is approved, they reimburse the <br />State and the City for their share. The time frames are such that the City <br />may have to acquire property at 100% of the cost, even before MN DoT is <br />ready to participate. As far as MN DoT and FAA reimbursement, there should <br />not be any problem so long as the City follows proper procedures in making <br />acquisitions. The City will know if MN DoT is participating after the <br />Environmental Impact Statement is completed; FAA and MN DoT are reviewing <br />the oontracts for the EIS at this time; will contact those agencies to <br />expedite contract approval. <br /> <br />Mr. Otto stated that MN DoT has expressed concern with respect to Ramsey's <br />airport zoning being accomplished by the City and not a joint zoning board <br />of the impacted agencies; they would like to see some type of liaison <br />established with the other agencies (Anoka, Dayton, Champlin, Anoka County <br />and Hennepin County) letting them know how they will be impacted. <br /> <br />Mr. Hartley stated that staff will set up appointments to communicate with <br />those agencies regarding Ramsey's pending airport zoning and the impact to <br />them. <br /> <br />Mr. Otto stated that another concern of MN D0T is that the Zoning Ordinance <br />proposes that City Council will serve as the Airport Zoning Board and <br />Planning and Zoning will serve as the Airport Board of Adjustment. It is <br />~ DoT's recommendation that in order to provide the necessary expertise, <br />the Airport Board of Adjustment be comprised of a combination of Airport <br />and Planning Commission members. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Sorteberg to <br />adopt Resolution #87-39 authorizing that the Ramsey City Council will serve <br />as the Airport Zoning Board. (Please refer to resolution file for <br />Resolution #87-39). <br /> <br />Motion carried.
