Mr. Hendriksen noted that the Carson case also did not come before P&Z <br />until after the building was built; it was a situation of two persons <br />requesting and obtaining the same dispensation from two different bodies. <br /> <br />Councilmember Cox noted that Council unanimously agreed that the Hickman <br />case would be handled by staff and himself; it was Council's prerogative to <br />handle the situation in that manner and they did. <br /> <br />Mr. Hendriksen inquired as to why it is Council's prerogative to do so when <br />side yard setbacks are within the realm of the Board of Adjustment. Mr. <br />Hendriksen stated that governing bodies and advisory commissions have to be <br />perceived as treating all citizens fairly. The reason Ramsey has a charter <br />snd a city newletter is because the City has not been perceived as treating <br />all persons squally in the past. The situation on January 27 and others <br />like it cause people to have those perceutions. <br /> <br />Councilm~ber Cox noted that Ramsey has always had a newsletter; citizen <br />perception and displeasure with the city did not bring about the <br />newsletter. <br /> <br />Mayor Reimann stated that the reason there is a charter is because people <br />thought they could stop sewer and water with it. Mayor Reimann stated that <br />there are going to be variations but he would like to see policies <br />established and handled in a consistent manner. Another example of <br />inconsistent actions between P&Z and Council is the Jake Barthold case. <br /> <br />Councilmember COx inquired as to why P&Z did not refer Mr. Hickman to the <br />Board of ~djustment. <br /> <br />Mr. Zir~erman stated that P&Z asked Mr. Hickman to come back with a site <br />plan and P&Z would recommend approval of the variance needed; Mr. Hickman <br />never came back and ended up taking his case to Council. <br /> <br />C~uncilmember Cox stated that Mr. Hickman approached him after his meeting <br />with P&Z and he was very upset; there is no sense having a big hassle when <br />it is after the fact; the attorney indicated legal problems associated with <br />requiring accomplishing certain things after the fact. The voting public <br />expects responsibility to lie with council at certain times; council is <br />their elected representatives. Advisory committees do not necessarily have <br />to agree with council actions but they should accept them and not get <br />everybody irritated. <br /> <br />Mayor Reimann stated that if there was a mistake made on the Hickman <br />situation, Council and P&Z should try to learn from it; that he takes <br />responsibility for the error and there is no going back. The purpose of <br />this meeting is to set direction and rules to be followed in the future. <br /> <br />Mr. Deemer noted that the Hickman situation was taken out of P&Z's hands <br />before P&Z had a chance to recommend that he make application and appear <br />before the Board of Adjustment.
