Abstain: Councilmember Pearson. <br /> <br />Case #2: Response From Mr. Art Raudio And H&S Asphalt Company Regarding <br /> Sale Of Land: <br /> <br />City Attormey Goodrich referred to a letter dated August 13, 1987 from <br />Richard L. Diamond of Estes Parsinen & Levy Law Offices indicating that <br />their firm has been retained by Art Raudio and H&S Asphalt Company with <br />respect to the proposed platting of Pineview Estates Third Addition. The <br />letter states that the clients are withdrawing any offers to permit the <br />City to purchase any portion of the subject property. <br /> <br />Councilmember Cox questioned whether Art Raudio and H&$ Asphalt have the <br />authority to withdraw the property from sale as the City has a letter dated <br />July 13, 1987 from Gilbert Menkveld offering the property for sale. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson directing <br />the City Attorney to research the legallity of the City ordering the <br />removal of all organic materials imported to Pineview Estates Third <br />Addition; to prepare a response to issues raised in the August 13, 1987 <br />letter from the law firm of Estes Parsinen & Levy retained by Mr. Art <br />Raudio and H&S Asphalt; and to report back to Council. <br /> <br />Further Discussion: Mr. Goodrich stated that he should be able to report <br />back to Council at their first meeting in September. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />Pearson and DeLuca. Voting No: None. <br /> <br />Case #3: <br /> <br />Authorize City Attorney To Initiate A "Quick Take" For <br /> Property Needed For Road Right-Of-Way (Frontage Road South <br /> Of U.S. Highway #10 NW): <br /> <br />Mr. Goodrich stated that Council has authorized condemnation proceedings <br />for necessary road right-of-way for the frontage road south of U.S. Hwy. <br />#10; negotiations are taking longer than expected; requesting authorization <br />to intiate "quick take". <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Cox to <br />adopt Resolution #87-206 authorizing the City Attorney to initiate a "quick <br />take" for property needed for road right-of-way (frontage road south of <br />U.S. Hwy. #10 NW). (Please refer to resolution file for Resolution #87- <br />206). <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson.
