Winslow Holasek - Andover Blvd., Andover - Stated that he didn't receive <br />notification of the October 16 hearing until October 10. Mr. Holasek <br />reviewed the amount of area to be acquired from him and the estimated <br />assessments for sewer, water, storm sewer and MSA road and the city's <br />offer. Mr. Rolasek stated that he has a purchase agreement offering almost <br />double what the city is offering for almost the same property in the same <br />vicinity. Mr, Holasek contended that the city's trade for assessments <br />offer is actually putting the land at 1/4 of what it is worth; if property <br />owners are expected to pay full assessments, then the City should be <br />willing to pay the full worth of the property. Mr. Holasek stated that due <br />to the timing in which he received notification of the October 16 hearing, <br />he is requesting that Council delay that hearing to a later date. <br /> <br />Mr. Goodrich stated that there is nothing Mr. Holasek has to provide for <br />that hearing. <br /> <br />Mr. Holasek stated that he wants his appraisal, which is to be paid for by <br />the city, and his attorney prepared for that hearing. <br /> <br />Mayor Reimann stated that using all the City's MSA funds for this project <br />will hinder other needed projects in the City and noted that the property <br />owners would benefit from the road as much as the city would. <br /> <br />Mr. Rolasek disagreed amd stated that the property owners have highway <br />in front of their property and don't need the frontage road; the frontage <br />road will depreciate residential property in that area. <br /> <br />Randy Elofson inquired if the city is willing to offer the appraised value. <br /> <br />Councilmember Cox stated that he is not willing to offer the appraised <br />value as the City is using tax increment revenue from another development <br />area (that paid for all their improvements up front and provided all the <br />necessary easements) to pay for sewer and water service in this area. The <br />city also has limited MSA funds and there are some much needed east/west <br />corridors. Accesses to Rwy. #10 will be very limited and further <br />development of this subject area will require construction of service <br />roads; if the MSA road is not provided for at this time, developers of the <br />area will be responsible for construction of it in the future. <br />Councilmember Cox stated that he doesn't know of any other development in <br />Ramsey where the efforts of another development area were used to provide <br />sewer and water with deferred assessments allowable. Councilmember Cox <br />stated that if the opportunity exists, getting sewer and water to this area <br />via the Rwy. #10 easement should be used. Councilmember Cox noted that a <br />high priced purchase of easements is considered a comparable sale and will <br />affect land valuation and property taxes for adjacent property. <br /> <br />Mr. Goodrich stated that options are: 1) Continue condemnation through <br />the courts. This process has the City defending it's appraisal and the <br />property owner's would defend theirs; the minimum the city would end up <br />paying for the easements is the city's appraised amount, $25,000/acre. 2) <br />Delay court hearing and continue to negotiate; 3) Cease condemnation and <br />City Council/October 13, 1987 <br /> <br />Page 15 of 18 <br /> <br /> <br />
