have held the land for a long time and were not ready to develop; the <br />improvements would increase the value of their land; hopes an affordable <br />solution can be arrived at. Councilmember Cox stated that if the property <br />owners feel they are being forced to develop, then the alignment should be <br />revised to follow the highway right-of-way; in fairness to those developers <br />that have paid and those that will, a large amount of money should not be <br />paid for these easements. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Case #6.A~ Ken Miller Well Problem: <br /> <br />Mr. Hartley stated that Mr. Ken Miller's 20 foot well has lost it's water <br />production capability; the well is in the area where sewer and water <br />construction is taking place; that construction included dewatering. <br /> <br />Mr. Raatikka noted that dewatering ceased about one month ago and the water <br />table is back to within one foot of where it was the first part of <br />September. Attempts have been made to pump Mr. Miller's well, but the <br />quantity of water was low and contained a lot of sand; the well is 37 years <br />old, has had no repairs to it, does not meet code and it's questionable <br />that it will recover. <br /> <br />Mayor Reimann inquired if there is proof that the well was functional <br />before sewer and water construction began. <br /> <br />Mr. Hartley stated that the burden of proof would be on the part of the <br />city to prove the well was not functional prior to construction in the <br />area; the city does not have that evidence. Mr. Hartley suggested that a <br />solution might be to enter into an agreement with Mr. Miller that when his <br />property changes hands, water connection charges and pending assessments <br />would be paid but during the interim he would be allowed to connect to the <br />service and pay user fees for water. <br /> <br />Councilmember Cox stated that the subject well has a history of malfunction <br />and not being acceptable for human consumption; Mr. Miller has admitted, <br />within the last 3 months, to not being able to use this well and having <br />to buy bottled water all this time. Historically, the well is not <br />acceptable and the taxpayers should not have to pay for Mr. Miller's <br />situation. Councilmember Cox also noted that dewatering would not cause <br />the well to pump sand. <br /> <br />Motion by Councilmember DeLuca and seconded by Sorteberg directing city <br />staff to research the history of Mr. Ken Miller's well and report back to <br />Council on December 8, 1987. <br /> <br />Motion carried.
