Voting No: None. <br /> <br />C~e #14: <br /> <br />Enforcement Of Buildin~ Code Regarding Automatic Sprinkler <br /> Systems: <br /> <br />Mr. Hartley stated that the automatic sprinkler system requirement has been <br />brought up for discussion as a result of current remodelling being done at <br />LeTourneau's Super Valu on 167th. The Building Code states that any <br />building being built or remodelled is required to install a sprinkling <br />system and that requirement is not exclusive to areas having municipal <br />sewer and water. Building Official Erickson is offering that although the <br />city cannot deviate from State Building Code and expect him to maintain his <br />certification, the city can consider allowing the construction of a <br />sprinkler system with an outlet for use by the fire department and the <br />pressure tank of the system being installed at a later date. <br /> <br />Mayor Reimann recalled that in the past, the city waived the automatic <br />sprinkling system requirement. <br /> <br />Mr. Goodrich agreed and stated that he would have to contact the former <br />building inspector to determine the rationale those waivers were based on. <br />Mr. Erickson has also noted that the city recently adopted the 1985 UBC <br />code and waiving of sprinkler system requirements might have been allowed <br />for under the 1976/79 UBC that was in effect at the time of those waivings. <br /> <br />Mr. Erickson noted that Rum River and River's Bend Plazas were not required <br />to install sprinkler systems because each of the centers have a 1 hour <br />occupancy separation wall to keep each area under the maximum of 12,000 <br />square feet where a sprinkler system would be required in a B-2 occupancy. <br /> <br />Mr. LeTourneau stated that he submitted plans and specs and made building <br />permit application about 7 weeks ago and was given a verbal go-ahead for <br />construction; 7 weeks later the city requires the sprinkler system that <br />will cost about $50,000; the remodelling cost is already up to $250,000; if <br />he had known of the sprinkler system requirement, he might not have gone <br />ahead with the remodelling project. <br /> <br />Mr. Goodrich stated he has a copy of a letter to Mr. LeTourneau's <br />architect dated October 27, 1987 stating that an automatic sprinkler system <br />would be required. <br /> <br />Mr. Erickson stated that directly after he found out there was construction <br />going on at the store, Mr. LeTourneau applied for a building permit on <br />September 24, 1987. At that time, one set of plans were submitted that did <br />not indicate any measurements; after the plans were scaled, it was <br />determined that a sprinkler system would be required. <br /> <br />Mr. LeTourneau requested that the City Attorney research the conditions <br />under which other businesses were excused from the sprinkler system <br />requirement and that he be allowed to do the same; he would be willing to <br /> City Council/November 24, 1987 <br /> <br />Page 14 of 16 <br /> <br /> <br />
