Commissioner Van Scoy introduced the following resolution and moved for its adoption: <br />RESOLUTION #14 -10 -206 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0936 RELATING TO A REQUEST <br />FROM GARY AND SANDRA STEINKE FOR A VARIANCE TO CONSTRUCT A <br />DETACHED ACCESSORY BUILDING THAT ENCROACHES ON THE ORDINARY <br />HIGH WATER MARK SETBACK OF THE RUM RIVER. <br />WHEREAS, Gary and Sandra Steinke, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 117 -256 (District Provisions) of the Ramsey City <br />Code to construct a detached accessory building within the established river setback on the <br />property generally known as 15825 Juniper Ridge Dr NW and legally described as follows: <br />Lot 5, Block 1, Reilley Estates Second Addition, Anoka County, Minnesota, subject to <br />easement as shown on the plat; subject to easement to the City of Ramsey and County of <br />Anoka Filed 9- 14 -78. <br />(the "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicants submitted an application for a variance on August 27, 2014. <br />2. That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 117 -53 of the Ramsey City Code on October 9, 2014, and that said public hearing <br />was properly advertised, and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br />3. That the Subject Property is zoned R -1 Residential (MUSA) and is approximately 0.92 acres <br />in size. <br />4. That the Subject Property is surrounded by properties also zoned R -1 Residential (MUSA). <br />5. That the Subject Property is located within the Scenic River Land Use District and is <br />classified as rural area per City Code Section 117 -254 (District Application). <br />6. That Section 117 -256 (District Provisions) (b) of City Code establishes a minimum building <br />setback of 150 feet from the Ordinary High Water Mark (OHWM) of the Rum River. <br />7. That Section 117 -111 (R -1 Residential District) of City Code allows one (1) driveway per <br />property in the MUSA district. <br />8. That Section 117 -349 (Accessory Uses and Buildings) (d) (12) d. of City Code permits <br />detached accessory buildings to be located nearer the front property line than the principal <br />
