<br /> <br />8.That the Applicant proposes to care for four (4) dogs that they own, provide boarding services <br />(dog sitting) for family members and friends without charging for said services, and <br />occasionally breed dogs. <br /> <br /> <br />9.That the Applicant has obtained written support for the conditional use from two (2) <br />neighboring property owners. <br /> <br /> <br />10.That six (6) residents residing on five (5) different neighboring properties have signed a letter <br />objecting to the approval of the conditional use permit. <br /> <br /> <br />11.That the Applicant proposes to eventually provide long-term foster care services for the same <br />size of dog until an owner is located. <br /> <br /> <br />12.That, based on regularity of boarding services coupled with lot size, the amount of twelve (12) <br />dogs on the Subject Property as related to the Permit is excessive. <br /> <br /> <br />13.That during a site inspection of the Subject Property on August 13, 2014, there was no evidence <br />of a home occupation being conducted on the Subject Property. <br /> <br /> <br />14.That an accessory structure was located in the rear yard of the Subject Property without the <br />necessary permits. <br /> <br /> <br />15.That the Applicant addressed the previously mentioned violation with the accessory structure <br />by removing it from the Subject Property. <br /> <br /> <br />16.That it appears that the proper enclosure in the front yard of the Subject Property encroaches <br />upon public right-of-way and will need to be relocated to be brought into compliance with City <br />Code Sec. 117-111. <br /> <br /> <br />17.That the proposed use will not adversely impact traffic in the area. <br /> <br /> <br />18.That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br /> <br />19.That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. <br /> <br /> <br />20.That the proposed use will not be hazardous to existing or future neighboring uses. <br /> <br /> <br />21.That the proposed use will be served adequately by public facilities and services such as <br />highways and streets. <br /> <br /> <br />22.That the proposed use will not create excessive additional requirements at public cost for public <br />facilities and services, and it will not be detrimental to the economic welfare of the community. <br /> <br />RESOLUTION #14-09-174 <br />Page 2 of 3 <br /> <br /> <br />
