City Attorney Goodrich explained that the language was drafted to address the issue of liability <br />as well as who will be responsible for upgrading the road to public standards. <br /> <br />Councihnember Strommen expressed concern that the language pertaining to the tree <br />preservation ordinance states that the ordinance requires an exhibit on what trees will be <br />removed, but nothing about tree replacement. <br /> <br />Community Development Director Frolik explained that the tree preservation ordinance <br />addresses that with multi family development, but with all single-family development two trees <br />arc required to be planted. <br /> <br />Councilmcmber Strommen replied that she was concerned that the way the language reads is that <br />it only indicates that they have to inform the City as to what was going to be taken down not <br />what was going to be replaced. <br /> <br />Case #5: <br /> <br />Request for Final Plat Approval of LeTendre Addition; Case of Robert <br />LeTendre and Theresa Wiebe <br /> <br />Community Development Director Frolik stated that Robert LeTendre and Theresa Wiebe, and <br />Mr. LcTendre's daughter and son-in-law (Jen'y and Jackie Bell), are requesting final plat <br />approval to rep]at two existing homesteads into a total of three lots. The property is located at <br />17120 Tiger Street NW. Robert LeTendre and Theresa Wiebe own a 17-acre parcel, where their <br />single family home is located. Jerry and Jackie Bell own the home that is located on the adjacent <br />2.5-acre parcel to the south. Robert LeTendre, Theresa Wieve and the Bells are proposing to <br />replat the two homesteads to create a new three-acre parcel for development. It is anticipated <br />that thc Bells will sell their existing home and build a new home on the new lot created. The <br />resulting lot sizes are 2.5 acres, three acres, and 14.2 acres, which meets or exceeds the 2.5-acre <br />minimum for the Rural Developing District. The Board of Adjustment granted a variance to <br />create a new buildable lot with less than the 200 feet of frontage per lot on Tiger Street <br />contingent upon the applicants including Jerry and Jackie Bells property in the replat. The <br />purpose for the contingency was to provide Mr. LeTendre the opportunity to reconfigure lot lines <br />in order that he and Theresa could gain control of the right-of-way alignment that would be <br />necessary for future extension of 171~t Avenue NW to the west side of Tiger Street. The sketch <br />plan was approved by the Planning Commission on November 6th. The plat was reviewed by the <br />Park Commission on November 13th and December 4th. A cash payment has been recommended <br />to satisfy park dedication requirements for Lot 1. <br /> <br />Motion by Councilmember Pearson, seconded by Councilmember Kurak, to adopt Resolution <br />#03-12-321 to approve the final plat of Letendre Addition contingent upon compliance with City <br />Staff review letter dated December 4, 2003 and the Developers entering into a development <br />agreement with the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Pearson, Kurak, Cook, Elvig, <br />Strommen, and Zimmennan.
