Motion by Cotmcilmember Kurak, seconded by Councilmember Pearson, to adopt Resolution
#03-12-338 approving the final plat for Highlands at River Park 4th Addition subject to the
conditions that existed at preliminary plat approval, compliance with City staff review letter
dated December 12, 2003, and the developer entering into the Development Agreement with the
City.

Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Pearson, Cook, Elvig,
Strommcn, and Zimmennan. Voting No: None.

Case #8:

Request for Final Plat Approval of Trappers Ridge Subdivision; Case of
Greg Bauer

Assistant Community Development Director Trudgeon stated that Greg Bauer is proposing a minor
subdivision for the purpose of reconfiguring two existing lots. One of the lots has an existing
residence located on it (7210 - 161st Lane). The total area to be subdivided is 14.17 acres and Mr.
Bauer would like to create a 2.5-acre parcel and a l l.67-acre parcel. The subject property has
fi'ontage on 16i'~t Lane and 160th Lane. Lot 2 as shown is deficient of the required 200-foot lot
width required at the street fi'ontage. The primary access will come from the 66-foot right-of-way
roi- 160t}' Lane NW. The Ramsey Board of Adjustment granted a variance to the 200-foot lot width
at their meeting on October 2, 2003. It should be pointed out that Lot 2 has an additional 105 feet
of fi'ontage along 161st Lane. Mr. Bauer is requesting that he be able to construct a private
driveway within the 160th Lane NW right-of-way. At a previous work session, the City Council
indicated that they would find this acceptable as long as future right-of-way for the possible
extension of 161st Lane NW is preserved as an easement. If the property were to be redeveloped in
the future, 160"~ Lane NW would be improved and extended to Mr. Bauer's property. The City has
received a legal description for the 66-foot road easement. This easement will need to be recorded
at thc same time the final plat is recorded. Staff recommended final plat approval of Trappers
Ridge subject to compliance with City staff review letter dated December 12, 2003 and the
applicant entering into a development agreement with the City.

Assistant Community Development Director Trudgeon noted that Mr. Bauer has concerns with
the language included under Section IV 12a because it would allow for the City to extend 161st
Lane NW if the property to the west is developed even if Mr. Bauer is not ready to develop his
land.

Councilmember Strommen inquired as to what the significant barriers are that impact the
placement of a road.

Assistant Community Development Director Trudgeon explained that there is a county ditch and
a very large wetland.

Councilmember Kurak stated that she was mostly concerned with Olivine coming through the
property. She inquired if there will be adequate room for Olivine to come through the property.

City Council/December 16, 2003
