City Administrator Norman explained that the City has changed the land use in the <br />Comprehensive Plan to residential so the City is required to make the change unless the Council <br />wants to go through a comprehensive plan amendment process. <br /> <br />Mr. ltolasek noted that the City just went through a comprehensive plan amendment process for <br />another property that was designated mixed use so he did not think it was that difficult of a <br />proccss. <br /> <br />City Attorney Goodrich explained that a comprehensive plan amendment would require a public <br />hearing and the :Met Council would have to approve the amendment. <br /> <br />Mr. ltolasek stated that someone is not going to purchase the property if they have to build it <br />residential. With a mixed-use designation it allows for them to buffer between residential and <br />commercial. <br /> <br />Mayor Gamec replied that if a developer comes in with a plan for commercial development then <br />the City can work with them. <br /> <br />Mr. Holasck noted that if the property is zoned residential the developer could place a residential <br />development right along the commercial area. <br /> <br />Mayor Gamec stated that they will probably find out that they will get more money for the <br />residential development than commercial development. <br /> <br />Councihnember Strommen agreed that it was a difficult situation, but if they put the two parcels <br />together, north and south of Riverdale Drive, there is a mixed use with the commercial area to <br />thc north and residential to the south, which make it analogous to the other situation the Council <br />previously approved for mixed use. <br /> <br />Councihnember Elvig stated that he was under the assumption that the critical river overlay was <br />a powerfi~l document to protect the waterfront and if that is not the case he did not think the <br />Council had any other choice but to zone the property residential. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Ordinance #03-53 to <br />rezone Tract C, Registered Land Survey No. 119, from B-3 Highway Business to R-1 <br />Residential. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Pearson aye <br />Counci hnember Elvig aye <br />Councihnember Strommen aye <br />Cotmci lmember Kurak aye <br />Councihnember Zimmerman aye <br /> <br />City Council/December 16, 2003 <br /> Page 22 of 33 <br /> <br /> <br />
