City Administrator/Economic Development Manager Brama reviewed the staff report and <br />recommendation to authorize conveyance of easements on HRA -owned property within The <br />COR in relation to the Highway 10 /Armstrong Boulevard Interchange Project. <br />Commissioner Kuzma asked if future development occurs, will Anoka County be paid back. <br />Asst. City Administrator/Economic Development Manager Brama stated the dollars paid to <br />Anoka County for the easements would not have to be paid back as the easement stays with the <br />property until it is removed. <br />City Engineer Westby concurred. <br />Asst. City Administrator/Economic Development Manager Brama explained that the need for the <br />runoff to be captured somewhere still exists. <br />Mayor Strommen asked about including language for future flexibility in the Joint Powers <br />Agreement (JPA) versus in the easement document. She stated it is a permanent easement and <br />asked if the JPA will survive long enough or if it should be reflected in the easement. <br />Asst. City Administrator/Economic Development Manager Brama stated there is a risk factor <br />and level of working in faith with Anoka County that in the future, they will allow a change to be <br />made. Also, a JPA does not last into perpetuity as an easement would. He stated that based on <br />past projects, Anoka County has always worked with local units of government and communities <br />if a storm pond had to be moved. <br />City Attorney Langel advised the JPA could include a term to survive past this project but it <br />could also be done in some fashion in the proposed deed. <br />Commissioner Strommen stated she wants to assure it is memorialized in the correct document. <br />Commissioner Riley stated this is a large marquee and highly developable parcel and he would <br />hate to see a $5,000 easement cost the City a million dollar development. He asked if other <br />locations were explored and if, on this site, a large use would need a storm pond anyway. <br />Asst.
