NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOBL4. COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #__, a Conditional Use Permit (Permit) to exceed the accessory <br />building size restriction for properties located outside the MUSA as established in City Code, <br />is hereby granted to Jeff and Barbara Rockow, hereinafter referred to as the "Permittee". <br /> <br />That the overall total square footage for accessory structures on the Subject Property may <br />exceed the 1,664 square foot allotment for properties located outside the Metropolitan Urban <br />Service Area by a total of 79 feet in order to accommodate the inside storage of trailers and <br />other equipment. <br /> <br />3. That the construction o~'the detached accessory, building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />4. That the accessory building shall be properly constructed and maintained in accordance with <br /> all applicable Building Codes. <br /> <br />5. The Permittee herein agrees that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code. <br /> <br />6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />That the Permittee shall be responsible for all City costs incurred in administering and <br />enIbrcing this Permit. <br /> <br />8. That the City Administrator, or his/her designee, shall have the right to inspect the premises <br /> for compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />9. That this Permit shall automatically expire if the use is not initiated by February 24, 2005, <br /> and issuance of the building permit shall constitute initiation. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this the 24th day of February, 2004. <br /> <br />RESOLUTION #04-02- <br /> Page 2 of 3 <br /> <br /> <br />
