Motion by Councilmernber Kurak, seconded by Councilmember Elvig, to table action and direct <br />staff to make changes to the ordinance based on the discussion. <br /> <br />Further discussion: City Attorney Goodrich noted that he would review Mr. Menard's <br />application to review what is pending and provide a recommendation on the $400. <br />Councilmember Elvig stated that there are a lot of people that have large lots in the City that <br />have to hold on to the property until development .moves further north. That is the problem with <br />an emerging community. The ordinance is to allow people to use their property, but they need to <br />have a strong hold on the situation. Mr. Menard does not have a unique situation in this <br />community. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Elvig, Cook, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #5: Request for Final Plat Approval of Valvista Estates; Case of Eugene Valerio <br /> <br />Community Development Director Frolik' explained that Eugene Valerio is requesting final plat <br />approval to create two new lots from his existing 9.67-acre parcel located at 16514 Jaspar Street <br />NW. Mr. Valerio owns a 1.9-acre parcel, where his single family home is located, and a 7.77- <br />acre parcel located immediately adjacent to his homestead (for a total of 9.67 acres). The <br />applicant is proposing to create two 2.5-acre parcels and maintain his existing single family <br />home on a 4.67-acre parcel. The property is located within the Rural Developing Area and, <br />therefore, subject to a 2.5-acre lot minimum, all lots meet or exceed this requirement. All three <br />lots meet or exceed the 200 feet of frontage on a public road requirement. The newly created lots <br />will gain access from 166th Avenue and the existing single family home will continue to gain <br />public access from Jaspar Street. The City Engineer has reviewed the soils map in th/s area and <br />has determined that there is sufficient Class I soils to support a primary and alternate septic <br />system. The Planning Commission reviewed the sketch plan at their November 6, 2003 <br />meeting, approved it and recommended that the developer proceed to final plat. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to adopt <br />Resolution #03-11-310 granting final plat approval to Valvista Estates contingent upon <br />compliance with the City Staff Review Letter dated November 21, 2003, and the developer <br />entering into a development agreement with the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Zimmennan, Kurak, Cook, <br />Elvig, Pearson, and Strommen. Voting No: None. <br /> <br />P34 <br /> <br />Case #6: <br /> <br />Request to Rezone Property form E-1 Employment District to Planned Unit <br />Development (PUD); Case of Basalt Properties, LLP <br /> <br />Assistant Community Development Director Trudgeon explained that Basalt Properties, LLP has <br />received approval to construct two cormnercial buildings on 2.62 acres along Basalt. N.W., south <br />of Highway t 16. As part of development, the subject property will be rezoned from E-l, <br />Employment to PUD, Planned Unit Development. On September 23, 2003, the City Council <br />adopted findings of fact supporting the rezoning and introduced the ordinance to rezone the <br />property.
