City AttorneylGoodrich explained that D.R. Horton does not want to have their ability to build <br />stopped. <br /> <br />Councilmembkr £1vig expressed concern that no senior housing or multi-use buildings can be <br />built unless th~ first benchmarks are met. <br /> <br />Assistant Community Development Director Trudgeon noted that there is a senior housing <br />complex that ii verY interested in locating in the Town Center. <br />Councilmemb~ Kurak inquired if it would get to the scenario that Mr. Elvig is suggesting, is <br />there somethidg that would allow the City to bypass that. <br /> <br />Councilmemb~r Strommen noted that she would not be in favor of changing any of the <br />benchmarks~ <br /> <br />Councilmemb~r Elvig stated that if D.R. Horton is ready to build fight away, he does not have a <br />problem with jthem having the capacity, but he does not want to give D.R. Horton the capacity <br />only an option~ <br /> <br />Councilmemb~r Kurak replied that Ramsey Town Center, LLC must have some idea of what is <br />happening witg the benchmarks. The City does not have all the information and she does not <br />want to micromanage what the master developer is trying to do. <br /> <br />Councilmemb~r Elvig stated that the CoUncil would be giving them the right to halt all other <br />residential devblopment. <br /> <br />CouncilmembCr Kurak replied that Ramsey Town Center, LLC would not allow that to happen <br />unless they w~e bad developers, which she did not think they were. <br /> <br />Councilmemb~r Strommen stated that they should allow D.R. Horton. to take the capacity at the <br />time they are readY to build rather than entirely up front. <br /> <br />Councilmember Kurak stated that Ramsey Town Center, LLC would not be entertaining the <br />senior citizen 6uilding if they did not have the commercial buildings in place. <br /> <br />Councilmember Elvig replied that then they need to clarify that. <br /> <br />Councilmembm' Kurak stated that there would be no reason for Ramsey Town Center, LLC to <br />sell the option ~f they did not have the commercial in place. <br /> <br />Councilmember Strommen replied that they need to make sure that is the case. <br /> <br />Councihnembqr Kurak inquired if the Council does pass the agreement tonight what time <br />constraint do'e~ that place on the agreement. <br /> <br />Councihnembe~r Elvig stated that he could accept the agreement as long as they have language in <br />place that would allow for other developers to come in if D.R.
