Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//04-02- <br /> <br />A RESOLUTION DENYING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />JEFF AND IBARBARA ROCKOW TO EXCEED THE SIZE RESTRICTIONS FOR <br />DETACHED ACCESSORY BUILDINGS ON PROPERTIES LOCATED OUTSIDE THE <br />METROPOLITAN URBAN SERVICE AREA (MUSA) <br /> <br /> WHEREAS, Jeff and Barbara Rockow (Permittee) have properly applied for a <br />conditional Use permit to construct an accessory structure that will exceed the size limits <br />established ir~ Section 9.11.02 (Accessory Structures) of the Ramsey City Code on the property <br />generally known as 18015 Ute St. NW and legally described as follows: <br /> <br />That part of the north half of the Northeast Quarter of Section 1, Township 32, <br />Range 2:5, Anoka County, Minnesota described as follows: <br /> <br />From a point on the east line of said north half of the Northeast Quarter said point <br />being 12.76 chains south of the Northeast comer thereof, said point also being the <br />centerlin~e of public road: thence south 82 degrees, 30 minutes west on said center <br />line of' sgid road a distance of 1010.0 feet; thence northerly parallel with the east line <br />of said Section l, a distance of 451.0 fee~ to the actual point of beginning of the tract <br />to be described, said last described line also being the easterly line of road easement; <br />thence easterly parallel with the north line of said Section 1, a distance of 155.00 <br />feet; thefice northeasterly deflecting to the left 40 degrees, 47 minutes 0 seconds a <br />distance [of 191.87 feet to its intersection with a line drawn parallel with and distant <br />700.0 feet west of the east line of said Section 1; thence northerly along said parallel <br />line a distance of 101.75 feet to its intersection with a line drawn parallel with the <br />north hne of said Section I, distance 227.0 feet north from the point of beginning as <br />measured along a line parallel with the east line of said Sect[on 1; thence westerly <br />along said parallel line a distance of 301..59 feet to its intersection with said line <br />drawn northerly and parallel with the east line of said Section 1 from the point of <br />begi~ming; thence southerly along said parallel line a distance of 227.0 feet to the <br />point of beginning. Together with an easement of access over a strip of land 30 feet <br />in width' extending from the aforementioned public road on the south and to the <br />north lilie of the tract herein described on the north and the easterly line of this <br />easement extending from a point on the centerline of the said public road which is <br />1010 feet from the east line of said Section .1 when measured along the said <br />centerline, and extending north to the northwest comer of the tract herein above <br />described. <br /> <br />(Subject Property). <br /> <br />AND WHEREAS, the Plamfing Commission conducted a public hearing on February 5, 2004, <br />pursuant to Section 9.03.04 of the Ramsey City Code. <br /> <br /> <br />
