P54 <br /> <br />Community Development Director Frolik noted that they would not be vacating the easement <br />entirely, the easement would have a different configuration. <br /> <br />Councitmember Elvig stated that he had thought the City owned part of the property. <br /> <br />City Attorney Goodrich replied that the City acquired an easement over the 3.8 acres. <br /> <br />Councilmember Strommen requested that staff provide a summary of all the information when <br />the case is brought back to the Council. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Pearson, to table action. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #3: Clandestine Drug Labs <br /> <br />Police Chief Way stated that to reduce public exposure to the health risks from hazardous <br />chemicals at suspected Clandestine Drug Lab Sites or associated dumpsites, notification and <br />cleanup procedures are needed. Such sites may contain suspected chemicals and residues that <br />place people, particularly children or adults of child bearing age, at risk when exposed through <br />inhabiting or visiting the site, now and in the future. Law enforcement must notify appropriate <br />municipal, child protection and public health authorities of the property location, owner, and <br />conditions found. Additionally, if there is a determination of the existence of a clandestine drug <br />lab site or chemical dumpsite, the property will be declared a public health nuisance. Property <br />owners are responsible for abatement of the public health nuisance. They must immediately <br />vacate those portions of the property, including building structures, which may place persons at <br />risk. Environmental testing and cleaning firms must also conduct on-site assessments of the <br />property. The property must notify the City of actions taken to clean up the site, and is <br />responsible for all costs of vacation or clean up of the site. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Elvig, to introduce an ordinance <br />amending City Code to add Section 5.17 Clandestine Drug Labs. <br /> <br />Further discussion: Councilmember Kurak stated that subdivision 3 indicates that a fee may be <br />established and inquired as to what that fee will be. City Attorney Goodrich recommended that <br />staff provide a resolution adopting a fee along with the adoption of the ordinance. <br /> <br />Motion carded. Voting No: None. <br /> <br />Case #4: <br /> <br />Request for Final Plat Approval of Riverbrook: Case of Wayne and Marian <br />Meloche <br /> <br />Community Development Director Frolik stated that Wayne and Marian Meloche were <br />requesting final plat approval of a minor subdivision to plat two rural residential lots, consisting <br />of one existing homestead and one additional lot. The subject property is located at 17400 <br />Erkium Street NW.
