City Attorney <br />Goodrich replied .that they could look at that, but it could not be done tonight. Councilmember <br />Elvig recommended that they draft a letter of understanding and then approve the final plat at the <br />next City Council meeting. Councilmember Cook stated the problem is they are talking about <br />something that is done at the discretion of the landowner. Councilmember Elvig stated that he <br />would be willing to go along with a statement that they intend to keep on discussing the issue. <br />Mr. Meloche stated that there will be no development on his property other than this split while <br />he is still alive. They have his word that he is looking into the conservation of the area because it <br />is to his benefit. Councilmember Kurak suggested that they approve the final plat contingent <br />upon the letter being drafted. City Attorney Goodrich recommended that he be given an <br />opportunity to meet with the applicant while the meeting continues and bring the case back up <br />for further discussion later in the evening. <br /> <br />Motion was withdrawn. <br /> <br />Councilmember Zimmerman stated that he was concerned that there was no public road <br />accessing the property. <br /> <br />City Attorney Goodrich explained that the Board of Adjustment granted the variance and the <br />City Council cannot change that. <br /> <br />Councilmember Zimmerman inquired if that decision exposes the City to any liability. <br /> <br />City Attorney Goodrich explained that the language was drafted to address the issue of liability <br />as well as who will be responsible for upgrading the road to public standards. <br /> <br />Councilmember Strommen expressed concern that the language pertaining to the tree <br />preservation ordinance states that the ordinance requires an exhibit on what trees will be <br />removed, but nothing about tree replacement. <br /> <br />Community Development Director Frolik explained that the tree preservation ordinance <br />addresses that with multi family development, but with all single-family development two trees <br />are required to be planted. <br /> <br />Councilmember Strommen replied that she was concerned that the way the language reads is that <br />it only indicates that they have to inform the City as to what was going to be taken down not <br />what was going to be replaced. <br /> <br />Case #5: <br /> <br />Request for Final Plat Approval of LeTendre Addition; Case of Robert <br />LeTendre and Theresa Wiebe <br /> <br />Community Development Director Frolik stated that Robert LeTendre and Theresa Wiebe, and <br />Mr. LeTendre's daughter and son-in-law (Jerry and Jackie Bell), are requesting final plat <br />approval to replat two existing homesteads into a total of three lots. The property is located at <br />17120 Tiger Street NW. Robert LeTendre and Theresa Wiebe own a 17-acre parcel, where their <br />single family home is located. Jerry and Jackie Bell own the home that is located on the adjacent <br />2.5-acre parcel to the south.
