Mr. Meloche stated the issue is City Code, which requires 200 feet of access to a City Road. He <br />indicated the other variance has been working beautifully for 14 years. He stated the variance <br />they are requeSting now is different than those requested previously, in that there is a home that is <br />there now, and they just want one other lot platted. He stated when the 40 acres to the north are <br />developed, which has been rezoned to 2 ¥2 acres per lot and is being prepared for development, a <br />road will be coming down to a permanent 66-foot easement at his property. He stated he spoke <br />with the City Engineer about access from that road and his willingness to provide a small cul-de- <br />sac at that time. <br /> <br />Mr. Meloche's daughter, Karen, stated she has lived close to her parents since she was a little <br />girl. She stated the last few years they have lived in different cities, and have the desire to be <br />neighbors agar. She indicated they would build a home in line with the houses that are there. <br />She stated there are a million personal reasons she wants to live close to her parents, and hopes <br />they can make it happen. She indicated they do not want to further subdivide the land, and do <br />not want to sell the rest off; they simply want to live close together. <br /> <br />Chairperson Nixt verified they would be platting one four-acre lot and a second lot for the <br />remaining acreage. <br /> <br />Mr. Meloche indicated that was correct. He stated the main reason'he sees for the 200 feet <br />requirement is :to ensure access for emergency vehicles and utilities. He indicated his home has <br />geo-thermal heat, and he predicts his daughter's home will as well. He stated the major reason <br />for the public road access is emergency vehicles and the concern the city would not be able to get <br />to them, but he would be more than willing to sign a 'hold harmless' agreement to the city. He <br />indicated they are able to maintain the road, and showed a picture of the tractor already on the <br />property. He stated the fire truck was there this morning, and had plenty of room to access the <br />property; big enough for even the City's biggest fire truck. <br /> <br />Chairperson Nixt asked what the deficiency was of the frontage. <br /> <br />Assistant Community Development Director Trudgeon stated they do not have any frontage <br />because it is a private road. <br /> <br />Chairperson Nixt asked about the possibility of deeding the land for the road to the City. <br /> <br />Assistant Community Development Director Trudgeon stated Mr. Meloche does not own the <br />land they would need for the easement, and the current owner is not interested in selling. He <br />indicated one issue for staff is that the driveway is ¼ mile long. They recognize it is well <br />maintained, but there is no guarantee that will continue. Staff does not want to get in the habit of <br />creating variances for private roads. He noted the current variance is 20 years old, and was done <br />with the stipulation there would be no other lot splits.
