City Attorney Goodrich replied that the ordinance states that fencing material must be wood or <br />chain link or other material as approved by the zoning administrator. <br /> <br />Community Development Director Frolik noted that that wording was added in 2002. <br /> <br />Mayor Gamec istated that he would recommend that the fence would have a setback of.at least <br />two feet from the property line to stop horses from reaching overthe electric fence onto adjacent <br />properties. If the fence is already located on the property line it would have to be moved by July <br />1'~' and if there is an issue with trees that have to be moved staff should be notified and the fence <br />may have to lie located in a temporary location until .the trees are removed. If people are <br />dumping onto ~he Konzak's property that needs to cease. He also recommended that only two <br />strands be elecffified rather than three. <br /> <br />Councilmember Cook stated that he thought they were going down a slippery slope because staff <br />was following the ordinance, which allows them to approve other materials and then once the <br />neighborhood Opposed what was approved now the Council: is looking at taking away his <br />property rights.' <br /> <br />Mayor Gamecrreplied that it is up to the City Council to hear 'both arguments and make a <br />decision. He ittquired if anyone on the Council was opposed to a minimum setback of two feet <br />from the property line for the exterior strand. <br /> <br />Councihnember Pearson inquired if the fence had already been installed to what the City <br />authorized. <br /> <br />Mr. Konzak r_~. ied';that the fence was installed this fall within a foot of the property line. <br /> <br />Councilmembet Elvig stated that he would like to add that there be a separation from the exterior <br />strand to the eldctric wire. <br /> <br />Councilmeml]? Kurak inquired asto hoW long Mr. Konzak would have to move the fence. <br />Mayor Garnet ~plied that he would like to see the fence moved by July 1, 2004. <br /> <br />Councilmembet; Ku'i'ak stated that when the ordinance was changed in 2002, it was written to <br />require chain link or wood, but they also recognized that Ramsey is a growing community so <br />they had to. allt)w for flexibility because there is a lot of rural areas where it would not be <br />reasonable tO ~r~uire a wood or chain link fence on ten acres. They even discussed the issue of <br />barbed wire :a~nd left that open as an option because there may be some c~rcumstances where it <br />~nay be necessary. <br /> <br />Councilmember Elvig stated that he agreed with what was being proposed because he believes <br />that was the essence of the initial agreement. <br /> <br />Councihnembe~ Kurak stated that she would support what the Mayor proposed also. <br />Councilmember Str°mmen noted that she would support that as well. <br /> <br />City Attorney Goodrich explained that staff would draft findings of fact based on the discussion <br />and bring it back at the next City Council meeting for formal action. <br /> <br /> <br />
