21. <br /> <br />22. <br /> <br />23. <br /> <br />That on January 13, 2004, the Subject Property Owners stated that relocation of the fence 2 <br />feet off the property line will require the removal of a significant number of mature pine trees <br />in order to l~rovide a fence line corridor void of any obstructions for the following reasons: a) <br />accomplish!tension necessary on wire strands to withstand the force of horses leaning against <br />the fence; ~) avoid any contact of the live wire strands with branches, etc., that would short <br />circuit the olectric system. <br /> <br />That on Jan. uary 13, 2004, the Subject Property Owners offered to eliminate the electric <br />feature frorfl the fence if the City would not require a 2 foot setback from property line. <br /> <br />That on Janr~Uary 29, 2004, the Subject Property Owners informed Staff that a 10~12 foot wide <br />clear path ih needed to accommodate the machinery necessary to remove the installed fence <br />posts from~Ithe ground. This also would require the removal of a significant number of <br />~nature pin~ trees. <br /> <br />24. <br /> <br />25. <br /> <br />CONCLUSION <br /> <br />That based on the above Findings of Fact, the City Council of the City of Ramsey herein declares <br />the following !idecision relating to a request for appeal of the Zoning Administrator's <br />Interpretation Of Ramsey City Code relating to permitted fence materials in an R-1 Residential <br />zoning district on the property owned by Bruce and Karen Konzack: <br /> <br />Affirmation of the ruling as described by the Zoning Administrator letter dated <br />November 20, 2003. <br /> <br />-or- <br /> <br />Reverse the ruling of the Zoning Administrator, which has the effect of not <br />Permitting the utilization of an electric wire strand fence as an acceptable fence <br />material. <br /> <br />-or~ <br /> <br />Modify the ruling of the Zoning Administrator, which has the effect of permitting <br />the electric wire strand fence as an acceptable fence material provided that the <br />fence is placed a minimum distance of two feet from the property line by July 1, <br />2004, and that the fence be designed and constructed with a minimum of three (3) <br /> <br />RESOLUTION #04-02- <br /> Page 4 of 5 <br /> <br /> <br />
