existing developments until such time that the AUAR is completed and the official map for <br />Highway 10 can be implemented. <br /> <br />Associate Planner Wald explained that Staff anticipates the City Council will adopt the final <br />AUAR document in January of 2004. The process to officially map the Highway 10 area is <br />anticipated to be completed in March or April of 2004. She indicated the first six month term of <br />the moratorium is set to expire on February 25, 2004. Since the properties are in a state of <br />transition and the development moratorium is set to expire soon, it would seem appropriate to <br />create a zoning district that addresses these properties specifically. <br /> <br />Associate Plarmer Wald indicated the subject area is currently zoned B-2 Highway Business. <br />Staff is proposing m create a new zoning district, H-1 Highway 10 Business District for the <br />properties currently within the moratorium. <br /> <br />Chairperson Nixt noted for the record the letter from Carlson, Lundquist & Company, Ltd, <br />signed by James R. Korin, in addition to the letter from Furniture and Things. <br /> <br />Commissioner Johnson joined the meeting. <br /> <br />Chairperson Nixt asked what will happen February 25, 2004. <br /> <br />Associate Planner Wald indicated the City Council can extend the moratorium for a total of 30 <br />months. <br /> <br />Assistant Community Development Director Trudgeon noted there was a lot of concern from <br />businesses at the time the moratorium was placed. He indicated the City Council committed to <br />only a six month time frame, and he does not think they will extend it. <br /> <br />Chairperson Nixt commented they should not push through an ordinance because of poor <br />planning. He indicated the moratorium limits owners on what they can do on their land, and he <br />does not know if that is just. <br /> <br />Assistant Community Development Director Trudgeon indicated the question becomes to what <br />extent they allow expansion, which drives up the cost of a Highway 10 project and makes the <br />project that much more unlikely. He indicated they need to balance the rights of the owners with <br />the costs and necessity of the project. <br /> <br />Associate Planner Wald advised that what Staff did was take the B-2 ordinance and adjust it so <br />any expansion has to go through an approval process to see if it fits with what the City sees <br />happening in that area. She noted the second change was a reduction in the area a building could <br />cover, from 35% to 25%. She added the new uses take out motels and hotels, since Staff felt <br />they may not be appropriate in this corridor.
