Assistant Community Development Director Trudgeon explained that D.R. Horton's first phase <br />will be north ofthe PACT Charter school and then move west. <br /> <br />Councilmember Elvig stated that if in fact D.R. Horton has purchased the option for all <br />residential development in the first phase and the benchmarks are in place they may be passing <br />up other good developers. <br /> <br />Mayor Gamec stated if there is no commercial development, then yes, that may occur. <br /> <br />City Administrator Norman stated that it is a difficult issue because the master developer has <br />come in with st!.ch a large project and the projeCt is limited because of the benchmarks so it stops <br />negotiations with other residential developers. Maybe the question is why did they bring in such <br />a big developer for the first phase. <br /> <br />Councilmember Zimmerman inquired if the agreement forces the City to run utilities to areas <br />they did not platt on for the first year. <br /> <br />City Attorney Goodrich replied that the City would control that based on the master development <br />agreement. <br /> <br />Councilmember Elvig inquired if D.R. Horton could develop west of the "key hole" under their <br />restrictions based on infrastructure plan. <br /> <br />Assistant Community Development Director Trudgeon replied no. <br /> <br />Councilmember Elvig stated that D.R. Horton has purchased the ability to block any further <br />residential development as long as they have the control, which he thinks puts themselves in a <br />vulnerable position. <br /> <br />Councilmember Kurak inquired if Mr. Elvig was saying that Ramsey Town Center, LLC should <br />not be selling land to D.R. Horton. <br /> <br />Councilmember Elvig replied not at all, but he does want to allow other sub developers to come <br />in as well. <br /> <br />Councilmember Strommen stated that she did not think that D.R. Horton should be allowed to tie <br />up all the capacity. <br /> <br />City Attorney Goodrich noted that D.R. Horton does not want to buy a big piece of land and then <br />be told that they have to stop development because of benchmarks. <br /> <br />Councilmember Etvig questioned the fact that D.R. Horton is buying an option does that mean <br />that other builders cannot build residential property until certain benchmarks are met. <br /> <br />Councilmember Kurak inquired as to what determines if a benchmark is met is it by building <br />permits or actual purchase of property. <br /> <br />City Council/November 25, 2003 <br /> Page 18 of 28 <br /> <br /> <br />
