the event the Ramsey Town Center project trunk lines are not projected to be operable on a date
acceptable to the City Engineer, the developer shall commence work to substitute the alternate
temporary holding facility with the required lift Station or gravity system. In order to ensure that
this work gets completed, the City is requiring an escrow of $155,000 to deposited with the City.
Councilmember Elvig stated that he recalled discussing that the units along C.R. #116 would be
staggered so that the units did not look like a straight wall, but he did not see that reflected on the
final plat.
Phil. Dommer, Bright Keys, explained that the boxes on the final plat are the boundary lines for
the common interest community lot. The building themselves are staggered and there is a
generous arnount of space between the two units.
Assistant Community Development Director Trudgeon stated that along Ramsey Boulevard the
final plat indicates that right of access restricting any additional accesses has been dedicated to
the County, but that was not the case along C.R. #116.
Mr. Dommer replied that he had no problem with making that change on the final plat. He
inquired if the well house access should be included.
Assistant Director of Public Works Olson replied that the City is able to give up that access as
well.
Motion by Councilmember Kurak, seconded by Councilmember Elvig, to adopt Resolution #03-
10 -282 to approve the final plat of Town Center Gardens contingent upon compliance with City
staff review letter dated October 10, 2003 and the Developer entering into a Development
Agreement with the City.
Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Elvig, Cook, Pearson,
Strommcn, and Zimmerman. Voting No: None.
Case #13: bequest for a Conditional Use Permit for a School Located in the Town
Center 3A Subdistrict
Assistant Community Development Director Trudgeon stated that Academic Investments Inc.
has submitted a site plan to construct a two - story, 71,350 square -foot Charter School on Lot 1,
Block 1, of the proposed Town Center subdivision. The Planning Commission reviewed the site
plan for the School on September 15, 2003, and recommended approval. On September 22,
2003, the City Council approved the site plan subject to the applicant receiving a Conditional
Use Permit in accordance with the Ramsey Town Center Zoning District Guidelines. The TC-
3a sub district requires that schools located in the Town Center must receive a conditional use
permit (CUP). In the Planning Commission site plan review, it was brought forward by Staff
that there were a few areas where the site plan did not meet all of the proposed Town Center
Draft Development Guidelines. It is the intent of this CUP to allow for these deviations from
City Council /October 14, 2003
