Assistant Director of Public Works Olson replied yes. <br />Councilmember Elvig stated that he was not sure how they could not require Academic <br />Investments to� post the escrow if they are going to require other developers to do so. <br />Allan Linoff, Academic Investments, Inc., stated that the area where the school will be located is <br />a separate zoning district and it is a school project so he did not know that it would set any kind <br />of precedent for other areas of developments. They will still be paying all the inspection fees as <br />inspections are done they would just not be required to pay the fees in advance. <br />Councilmember Kurak stated that she did not feel comfortable with setting a precedent in this <br />situation. <br />Mayor Gamec questioned if the Council felt that the City should be requiring an inspection <br />escrow. <br />Consensus of the City Council was to require an inspection escrow. <br />Assistant Community Development Director Trudgeon reviewed the language that was added to <br />the development agreement pertaining to park dedication. He explained that the reason <br />additional language was added to this section was the developer was concerned that that there <br />may already be a park dedication agreement in the works between Ramsey Town Center, LLC <br />and the City. The language added to this development agreement would alter the understating in <br />section 4.12 ofthe Ramsey Town Center, LLC development agreement and allow for a deferred <br />payment. <br />Mayor Gamec stated that he would like to get the park issue with Ramsey Town Center, LLC <br />moving along as quickly as possible. He requested that staff send Ramsey Town Center, LLC a <br />letter reminding them of the deadline on presenting a park plan. <br />COUnclllnem Cook inquired if the City settles an agreement with Ramsey Town Center, LLC <br />for park dedication will the City no longer ask sub developers for park dedication. <br />Assistant Community Development Director Trudgeon replied that that will depend on what the <br />agreement is. <br />City Attorney Goodrich noted that he did not feel that the language pertaining to park dedication <br />was precedent setting. <br />Assistant Community Development Director Trudgeon stated that the second sentence under <br />park dedication should be changed to read as follow: "Park dedication requirements may at the <br />City's absolute discretion be satisfied by a cash payment..." <br />Consensus was to include the amended language pertaining to park dedication in the <br />development agreement. <br />City Council /October 14, 2003 <br />Page 25 of 30 <br />
