Mayor Gamec stated that it seemed to him that their only option is to reduce the depth of the <br />Pipe. <br />COUnCillneâ–ºnber Strommen agreed. She stated that if they know that there are drainage problems <br />in the area they need to fix it now. <br />Councilmember Elvig inquired as to who was responsible for putting together the contour maps <br />for a development. <br />Assistant Director of Public Works Olson replied the developer's engineering firm. <br />Councilmember Zimmerman stated that staff is going to have to work with the neighbors and the <br />developers to resolve the issue. <br />Assistant Director of Public Works Olson noted that the developer does have certain rights as <br />well. The developer has the ability to discharge at the same rate as before development occurred. <br />Mayor Gamec stated that as a City they need to fix a problem that they know may occur. <br />Paul Kangas, Loucks Associates, stated that the area was always a captive basin, which was <br />known throughout the design process. They are not increasing the amount of water that goes into <br />the area and the new pipe that outflows the area is meant to keep water from reaching the house <br />levels. It was understood that some ponding would occur because it always has. The issue he <br />wanted to clarify tonight was the tree preservation. They were asking for authorization to <br />proceed with clearing to the original tree preservation line. He explained that they originally did <br />not clear to the tree preservation line because they were concerned that there may be a <br />discrepancy. <br />Councilmember Strommen inquired if Mr. Kangas was referring to all three areas or only area A. <br />Mr. Kangas replied that he was primarily talking about area A. <br />Mayor Gamec inquired if in area A they would be grading to the original tree preservation line. <br />Mr. Kangas replied in the affirmative in addition to allowing for some brush removal and grading <br />with small equipment within the tree preservation area to provide for drainage for Lot 4. <br />Assistant Director of Public Works Olson noted that with the tree preservation line they can get <br />positive drainage. <br />Councilmember Cook stated that he personally walked the site and he did not see a problem with <br />what the developer was proposing for trees. <br />Councilmember Elvig inquired if they were sure that they are on the original tree preservation <br />line. <br />City Council /October 14, 2003 <br />Page 8 of 30 <br />i <br />
