Councilmember Pearson introduced the following resolution and moved for its adoption: RESOLUTION #03-11-302 RESOLUTION APPROVING 1sT PARTIAL PAYMENT TO W.B. MILLER, INC. FOR IMPROVEMENT PROJECT #03-27 (141sT AVE. NW, AZURITE ST. NW AND BASALT AVE. NW) WHEREAS, on August 26th, 2003, City Council adopted Resolution #03-08-205 approving the plans and specifications for the above referenced work; and WHEREAS, Principal City Engineer Brian Olson inspected the completed work and recommended partial payment to W.B. Miller, Inc. in the amount of$155,872.11. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes 1st partial payment to W.B. Miller, Inc. for hnprovement Project #03-27, 141~t Ave., NW, Azurite St. NW and Basalt Ave. NW project in the amount of$155,872.11 on November 25, 2003. 2) That the City Council authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of November 2003. 4) That the City of Ramsey Finance Department will be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Kurak and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Pearson Councilmember Kurak Councilmember Cook Couneilmember Elvig Couneilmember Strommen Councilmember Zimmerman and the following voted against the same: none and the following abstained: RESOLUTION #03-11-302 Page 1 of 2
