Ramsey'$ apportunity for state or federal funds for airport improvements,
City Staf~.i recommends the inclusion of Item #34 in the proposed conditional
use permit. Item #34 indicates that the City can impose a surcharge on
landfill activities in the event they cause a delay or denial of state or
federal funds.

Mr. Otter stated that WMMI has agreed to performance goals but not to a
surcharge for causing a delay in receipt of funds for the airport project.
Mr. Otter noted that this clause places WMMI in the position of potentially
paying landfill surcharges for airport improvements delayed or denied
because of Mite P, if it is selected.

Council saw a problem in determining the cause for delay or denial of state
and federal funds.

Motion by Councilmember Sorteberg and seconded by Councilmember Bawden to
delete It~em ~34 pertaining to Landfill Surcharge from the proposed
conditional use permit.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers $orteberg,
DeLuca, Pearson and Bawden. Voting No: None.

Mr. Otter .referred to Item #33.b of the proposed conditional use permit
entitled 'Payment In Lieu Of Taxes' and stated that WMMI agrees to pay
commercial taxes on the ski hill operation but disagrees with paying taxes
equivalent to that of platted, vacant Industrial property on that portion
of the property not used by the ski hill facility.

Council noted that. WMMI is being taxed up front with the landfill tipping
fee; the intent of paragraph 33 .b is addressed in the city's
recommendations for legislation regarding hosting communities.

Motion by Councilmember Bawden and seconded by Councilmember Pearson to
revise Item ~33.b in the proposed conditional use permit to read as
follows: 'Ski Hill Taxes. Property taxes on the Ski Hill Facility shall
be assesBed at the rate of a commercial business operation.'

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg,
DeLuca, P~ar$on and Bawden. Voting No: None.

Edward Mo~rsfelder, attorney for WMMI requested that Item #17 (Airspace
Review) of the proposed conditional use permit be amended to clarify that
WMMI will cooperate with FAA directives but not be under the jurisdiction
of FAA.

Council consensus was that Item #17 of the proposed conditional use permit
should read as follows: 'Airspace Review. WMMI shall submit a notice of
proposed construction to the Federal Aviation Administration (FAA) and
shall co~ply with ~L~_P_~I~ applicable limitations, restrictions,
obstruction lighting, or operational controls to assure that the landfill
operation~ minimize hazards to air navigation.'

Council r~ce~ed at 10:00 p.m.
City Council/November 15, 1988
