PW CASE

CONSIDER ASSESSMENT POLICY REGARDING TOWNHOMES
By Steve Jankowski, City Engineer

Background:

At the Jarluary 17th Public Works Committee meeting a copy of the proposed 2004 Stre,.et
Maintenar~ce Pro,am was presented. This year's program calls for an overlay project
within the Rum River Estates subdivision, [P 04-14. This project was noted to be
somewha~ unique in that the benefited properties included a mix of uses which in..cluded
single family residences, town_homes and the golf course and raised a question aZ' t.q?the
proper method for assessing the townhomes. Staff was directed to survey other
communities, report on the methods they employed in similar situations, and make a
recommendation for modifying the City's current assessment policy.

Scope of the Issue: .. ;~i-

A review was conducted of all the townhome developments within the City. Below is a
listing of all such developments along with an identification of how a street project might
be assessed:

· Sunfish Ponds- P
· BirchHill Lodges - Unit
· ACCAP Townhomes (SunwoodTownhomes)- MSA
· Orchard Hill Townhomes - P
· Alpine Meadows - Unit
· Rum River Townhomes -P
· RiYenwick 3rd - Unit & MSA
· The Ponds-P
· Alpine Acres - Unit
· Evergreen Point Townhomes - Unit
· Senior Apt Dysprosium - MSA

Of the eleven developments listed above, the majority of them lend themselves to
assessment under the current policy where the total assessable project cost is divided
equally bY the' benefiting units. This is because all of the public streets in the subdivision
exclusively serve the townhouse units. These subdivisions are identified by the word
"Unit". Three developments, ACCAP, Senior Ap~ on Dysprosium Street, and Rivenwick
3''d, have frontage on MSA streets and could be assessed by our current policy which
assesses such unit the "average" cost of that type of improvement for that year. The
remaining four townhome subdivisions, including Rum River Town, homes associated
with I P 04-14, are labeled "P" for being problematic. Sketches of these developments
have beer/attached to assist in visualizing the problem. The Ponds could rather easily be
