Chairperson Nixt asked what would happen if a building is not currently in use and the owner <br />wanted to use it. <br /> <br />Associate Planner Wald stated they would have to apply for an SUP and go through site plan <br />review. <br /> <br />Assistant Community Development Director Trudgeon stated in Staff's minds this ordinance <br />allows the ov~0ers to reasonably use their land until such time as the City knows what will <br />happen, while at the same time preventing a million and a half dollar expansion when it is not <br />appropriate. <br /> <br />Chairperson N~t argued that if you currently have 0% coverage and wanted 2%, you would have <br />to come to the City for approval. <br /> <br />Assistant Community Development Director Trudgeon noted you would have to in any case in a <br />B-2 District. : <br /> <br />Associate Plamier Wald commented the SUP is sort of like a CUP, where you can do it, with <br />conditions. She gave an example of a business wanting to put up a building that was 100% brick. <br />The City may give them permission to use only 50% brick, so the building is not so expensive. <br /> <br />Commissioner .Johnson asked if the City is affirmatively looking at acquiring property for <br />Highway 10. <br /> <br />Assistant community Development Director Trudgeon stated they are doing an AUAR of the <br />Highway 10 Corridor for mapping, which puts everyone on official notice. This gives the City <br />the ability to apPly for funding for land acquisition. <br /> <br />Chairperson Ni~t summarized the letter from the law firm representing Highway 10 businesses, <br />indicated it stated while the ordinance is reasonable, it is not appropriate. The letter objects to <br />25% coverage, ~rnoting it is significantly less than the 35% allowed in B-2, and claims that by <br />limiting use of[the property the City intends to devalue the land. It claims the City Council <br />assured that thellresults of the Tinklenberg Group would be made public, and those results should <br />be made available before the City adopts this ordinance. It stated a change in the development <br />rights along theCorridor is not in the City's best interest, making note again it is not appropriate. <br /> <br />Assistant Comm~ unity Development Director Trudgeon indicated the AUAR will be ready for <br />final adoption ifi December, which is not the report the letter is referring to from the Tinklenberg <br />Group.
