CASE <br /> <br />REQUEST TO REZONE CERTAIN PROPERTY FROM R-1 RURAL RESIDENTIAL <br />NO R-1 URBAN RESIDENTIAL; CASE OF JAKE BARTHOLD <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Jake Barthold 4s requesting a rezoning of property proposed to be platted as Apple Ridge to <br />facilitate the development of single family homes. Owners of adjacent land not included in the <br />Apple Ridge Prat have joined in the petition for rezoning. <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to owners of property within 350 feet of <br />the subject property. Staff sent hearing notices to owners of property in excess of the 350 foot <br />requirement. <br /> <br />Observations: <br /> <br />The property is approximately 70 acres in size and is in the Metropolitan Urban Service Area <br />(MUSA). The' preliminary plat accompanying the application proposes to develop the entire <br />parcel with single family homes. The adjacent parcels to the north, south and west are zoned <br />rural residentia!. The Comprehensive Plan amendment initiated in 1993 and approved in 1995 <br />puts the subject'~property in the MUSA for residential development. <br /> <br />Certain community residents are of the opinion that the MUSA has not been expanded to include <br />ail of the Barth.01d property. However, Staff is of the opinion that this is not a correct position. <br />In response to this position, the City Council has directed the City Attorney to review this issue <br />and advise accordingly. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) PropOsed plat <br />c) Proposed Findings of Fact <br />d) PropOsed Ordinance <br /> <br />RecommendatiOn: <br /> <br />City Staff recommends approval of the request for rezoning as the definition of R-1 Rural <br />Residential zonir~g is in conflict with the intent of property in the MUSA. <br /> <br /> <br />
