MEMORANDUM <br /> <br />Date: <br /> <br />To: <br /> <br />From: <br /> <br />Re: <br /> <br />November 12, 1991 <br /> <br />City Administrator Ryan Schroeder <br /> <br />Zoning Administrator Sylvia Frolik <br /> <br />WMMI Conditional Use Permits <br /> <br />TIRE PROCESSING: <br /> <br />Term: The term of the tire processing CUP is consistent with the term for the CUP for <br />vertical expansion. <br /> <br />Operations Beyond Three Year Term: If the tire processing operation continues beyond <br />April 18, 1992, the waste tire storage shall be enclosed in a covered structure. The six <br />month extensions to the tire processing CUP shall take into consideration the provisions for <br />covered tire storage. <br /> <br />My opinion: Even though the term is stated as being consistent with the CUP for vertical <br />expansion, I believe 'consistent' referred to 3 year time frame and not the same expiration <br />date, The vertical expansion was approved for 3 years commencing in November of 1988; <br />the CUP for tire processing was approved several months later and therefore the magic date <br />of Aprii 18, 1992 came into play. Since this CUP mentioned that it was consistent with the <br />verticaI expansion CUP, then I would say that extensions of tire processing are not <br />required to go through reapplication and public hearing. However, whether or not there are <br />provisions for storing tires under cover will be a main consideration in ~anting extensions. <br /> <br />GRADING AND MINING: <br /> <br />North Area: The permission for grading and excavating from the north borrow area was <br />included in the conditional use permit for vertical expansion. The term on the excavation <br />portion of the permit was set at 3 years from the date of the restoration bond (April I9, <br />1989) or 3 years from July 1, 1989. The excavation portion of this CUP expires on April <br />19, 1992. <br /> <br />South Area: On November 26, 1985, WMMI was granted a 2 year CUP for grading and <br />excavating. That CUP expired on November 26, 1987. WMMI applied for and obtained a <br />6 month extension to May 26, 1988. To the best of my knowledge, this is the only grading <br />and excavating permit WMMI has had in recent years; the documentation in the f'fle referred <br />to the South Borrow area. According to my records, this CUP is void as of 5/26/88. <br /> <br /> <br />
