CASE #O~ <br /> <br /> FIREFIGHTER DISABILITY CLAIM <br />By: Sandra Ashley Helling, Finance Officer <br /> <br />Background: <br /> <br />At the direction of the Council's Personnel Committee and the Fire Board, I have <br />reviewed Mr~ Guimont's 1990 income tax returns for the purpose of establishing if Mr. <br />Guimont Wo~uld have been eligible for disability payments (in addition to workers' <br />compensatioO) under the policy initially proposed (December, 1990) for fire fighters. <br />See (A) belOW, <br /> <br />Mr. Guimontr als° submitted additional information regarding what his earnings might <br />have been but for his injury. While these projected earnings include business for <br />which he states ~he was awarded the bids and business he might have received if he <br />had been able to bid, for the purpose of this analysis his projection as presented has <br />been used to also determine a benefit level. See (B) below. However, it should be <br />noted that copies of contracts for bid awards or similar information has not been <br />made available to support the projection. <br /> <br />Mr. Guimont~s Projections for additional earnings during the last ten weeks of 1990 <br />are 1.9 (alniost double) the rate for receipts/sales for the first 42 weeks of 1990. <br />Therefore, I~haVe also determined the benefits that would have been payable if~,his <br />rate of receiPts/sales for the full year of 1990 is based upon the rate of the first' 42 <br />weeks. See (C) below.' <br /> Proposed Disability <br /> Plan December.1990 <br /> <br />(A) Per Mr, Guimont's Income Tax Return No benefit payable <br /> <br />(B) <br /> <br />Mr. GUimont's projection of earnings that <br />would have been realized but for <br />the Injury <br /> <br />$124.00/month (non taxable) <br />$184.00/month (taxable) <br /> <br />(c) <br /> <br />Gross Earnings Increased for the last ten <br />weeks !based on the receipts/sales <br />rate of the first 42 weeks (per <br />Income Tax Return) <br /> <br />No benefit payable <br /> <br />It should be noted that benefits under the proposed plan of December, 1990 are <br />determined by subtracting workers' compensation from the fire fighter's average <br />monthly income, and that difference is payable at 67% up to a maximum of $800.00 <br />per month While on full disability. At a regular CounCil meeting in December, 1990, <br />our former Council did approve the payment of $800.00 per month for the months of <br />November and December, 1990, based upon Mr. Guimont's statements that his earnings <br />were in excbss of $35,000 per year (thereby qualifying for the $800.00 payment). <br />Future payments were to be made after receipt of Mr. Guimont's tax returns verifying <br />his income level, but if it was found his income level was lower, the adjustment was <br />not to be made retroactive. <br /> <br /> <br />
