~" '~"-:~ CASE #1 <br /> <br /> FIREFIGHTER DISABILITY CLAIM <br />By: Sandra Ashley Helling, Finance Officer <br /> <br />Background - as of October 9, 1991: <br /> <br />At the direction of the Fire Board, a letter was sent to Mr. Guimont requesting the <br />following information: <br /> <br /> 1. Substantial evidence (copies of written contracts, verbal confirmation <br />from contractor or similar evidence) that Mr. Guimont was awarded the contracts for <br />jobs listed as "Lost Income, 1990". A copy of the listing was attached. <br /> <br /> 2. ^ confirmation of the time period for which Mr. Guimont is requesting <br />additional diSability payments. <br /> <br /> 3. Mr. Guimont's doctor's estimate as to the time period he will again be on <br />total disability due to surgery scheduled for November of this year. <br /> <br />Mr. Guimont was advised this information must be received by October 1; as of <br />October 3, nO information has been received. <br /> <br />As included in the August 28, 1991 Fire Board agenda, a determination of benefits <br />that would ihave been payable under the disability policy originally proposed in <br />December of 1990 was made and is restated below. <br /> <br />Proposed Disability <br />Plan December.1990 <br /> <br />(A) Per Mr~ Guimont's Income Tax Return <br /> <br />No benefit payable <br /> <br />(B) <br /> <br />Mr. Guimont's projection of earnings that <br />would have been realized but for <br />the injury <br /> <br />$124.00/month (non taxable) <br />$184.00/month (taxable) <br /> <br />(c) <br /> <br />Gross Earnings increased for the last ten <br />weeks based on the receipts/sales <br />rate of the first 42 weeks (per <br />Income Tax Return) <br /> <br />No benefit payable <br /> <br />It should be noted that benefits under the Proposed Plan of December, 1990 are <br />determined by subtracting workers' compensation from the fire fighter's average <br />monthly income, and that difference is payable at 67% up to a maximum of $800.00 <br />per month while on full disability. At a regular Council meeting in December of 1990, <br />our former Council did approve the payment of $800.00 per month for the months of <br />November and December of 1990 based upon Mr. Guimont's statements that his <br />earnings were in excess of $35,000 per year (thereby qualifying for the $800.00 <br />payment). Future payments were to be made after receipt of Mr. Guimont's tax returns <br />verifying his income level, but if it was found his income level was lower, the <br />adjustment was not to be made retroactive. <br /> <br /> <br />
