~" '~"-:~ CASE #1

FIREFIGHTER DISABILITY CLAIM
By: Sandra Ashley Helling, Finance Officer

Background - as of October 9, 1991:

At the direction of the Fire Board, a letter was sent to Mr. Guimont requesting the
following information:

1. Substantial evidence (copies of written contracts, verbal confirmation
from contractor or similar evidence) that Mr. Guimont was awarded the contracts for
jobs listed as "Lost Income, 1990". A copy of the listing was attached.

2. ^ confirmation of the time period for which Mr. Guimont is requesting
additional diSability payments.

3. Mr. Guimont's doctor's estimate as to the time period he will again be on
total disability due to surgery scheduled for November of this year.

Mr. Guimont was advised this information must be received by October 1; as of
October 3, nO information has been received.

As included in the August 28, 1991 Fire Board agenda, a determination of benefits
that would ihave been payable under the disability policy originally proposed in
December of 1990 was made and is restated below.

Proposed Disability
Plan December.1990

(A) Per Mr~ Guimont's Income Tax Return

No benefit payable

(B)

Mr. Guimont's projection of earnings that
would have been realized but for
the injury

$124.00/month (non taxable)
$184.00/month (taxable)

(c)

Gross Earnings increased for the last ten
weeks based on the receipts/sales
rate of the first 42 weeks (per
Income Tax Return)

No benefit payable

It should be noted that benefits under the Proposed Plan of December, 1990 are
determined by subtracting workers' compensation from the fire fighter's average
monthly income, and that difference is payable at 67% up to a maximum of $800.00
per month while on full disability. At a regular Council meeting in December of 1990,
our former Council did approve the payment of $800.00 per month for the months of
November and December of 1990 based upon Mr. Guimont's statements that his
earnings were in excess of $35,000 per year (thereby qualifying for the $800.00
payment). Future payments were to be made after receipt of Mr. Guimont's tax returns
verifying his income level, but if it was found his income level was lower, the
adjustment was not to be made retroactive.
