CASE #6 <br /> <br />REQUEST TO REVIEW SKETCH PLAN; <br />CASE OF GERALD BAUER <br /> By: James Gromberg, Project Manager <br /> <br />Background: <br /> <br />Gerald Bauer js requesting sketch plan review to plat property located east of St. Francis Blvd. <br />N.W. and Gobernatz Addition at 177th Avenue N.W. The proposed subdivision consists of <br />reconfiguringthree existing lots totaling approximately 48.5 acres. The individual lot sizes <br />resulting from the reconfiguration would be 2.5 acres, 9.7 acres and 35.1 acres. <br /> <br />Observations: <br /> <br />The proposed Subdivision would comply with the "4 in 40" density requirements because there is <br />and will continue to be three lots in 48 acres. However, the minimum lot size in the Rural Service <br />Area is ten acres. I believe in this particular case, the City could vary from the ten acre minimum <br />lot size because there is not a creation of new lots but rather a realignment of existing lot <br />boundaries. <br /> <br />Mr. Bauer is requesting that the subdivision be considered a minor subdivision. A minor <br />subdivision is defined as a plat containing three lots or less that requires no public improvements. <br />Mr. Bauer is not proposing to extend and improve 177th Avenue N.W. so that Lot 3 will have 200 <br />feet of frontage on a public road. Mr. Bauer has stated that he has no desire to remedy the Lot 3 <br />landlock status; because he has no immediate plans to develop Lot 3 and therefore is not concerned <br />that it would be a substandard lot not eligible for a building permit at this time. <br /> <br />Regardless of the decision made at the March 5, 1991 Planning and Zoning Commission meeting <br />whether full or minor subdivision, City Code indicates that no park dedication will be required. <br />Since no new lots are being formed, only a realignment of existing lot lines, the City should not <br />require any park dedication at this time. However, if in the future any of the lots are subdivided, <br />park dedication would be collected at that time. <br /> <br />The sketch plan is being presented to the Planning and Zoning Commission on March 5, 1991 for <br />determination of sketch plan approval. <br /> <br />Recommendation: <br /> <br />Staffs recommendation to the Park and Recreation Commission is that no park dedication is <br />required for the Bauer Subdivision or Minor Subdivision. <br /> <br />Park and Recreation Commission Action: <br /> <br />Motion to recommend that the City Council not require park dedication for the Bauer Subdivision <br />or Minor Subdivision at this time. <br /> <br />Review Checklist: <br /> <br />P&R: 3/7/91 <br /> <br />Zoning Adminisn'ator <br />City Engineer <br /> <br /> <br />
