ARTICLE FIVE <br />REIIIIIBURSEMENT OF COSTS <br />The Developer agrees to fully reimburse the City for all costs incurred by the City in <br />connection with this teveLopment Contract including, but not limited, to the actual costs of <br />preparation of the p t and specifications for said improvements, engineering fees, legal <br />'fees, inspection fees interest costs, costs of acquisition of necessary easement, if any, <br />and any other costs ncurred by the City relating to this Development Contract and the <br />installation of the afoirnentioned improvements. <br />Furthermore, the - Developer Fees to deposit with the City such sums <br />reasonably required by the City and relating to the costs described in the preceding <br />paragraph. The arneunts of such deposits shall be shown in Exhibit A (Fee Schedule) <br />attache hereto and made a part hereof and adopted by City Code. Said amount shall <br />bear no interest and he City shall have the tight to.pay all fees and expenses and costs <br />which are the'obliga lions of the Developer under this contract from the afoiementioned <br />escro deposit An( monies remaining after the payment of said fees and costs shalt <br />be returned to the Developer any disputes regarding said fees shall be resolved in <br />accordance with ItilS462.353 and 462.361.. <br />_ ARTICLE SIX <br />BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY <br />Where- a pia ed street intersects an existing publicly maintained road, the City <br />Building Official will only issue building permits on lots that are within 150 feet of a hard <br />surfaced roadway. I i the event tots are more than 150 feet from a hard surfaced roadway,. <br />the Developer shall construct a gravel service road to provide access to. these lots as <br />required by the city. The Developer shall submit a plan to the City for approval identifying <br />the location -of the proposed access roads and the lot being requested for building <br />• <br />permits. Building p rmits can be requested for the remaining tots within the development <br />after; the first lift of t e asphalt has been installed on the street. The City shall require that <br />a "Hold Harmless Pgreemene be provided .by the Builder if the drainage improvements <br />serving the deve t (i.e. ponds, .outlet structures, and overflow pipes) are not <br />completed prior to . building permit being issued. No certificate of occupancy will be <br />issued on any lot t abuts a pond unless the pond infrastructure is completed according <br />to the Gity approve plan. <br />
