Anyone who violates the provisions of this article shall be guilty of a petty <br />misdemeanor. Anyone who violates the provisions of this article in a manner involving <br />conduct prohibited by Section 34-163 of the Code of the City of Ramsey shall be guilty <br />of a misdemeanor and shall have any license given by the City of Ramsey revoked. Any <br />massage establishment in which a violation involving Section 34-163 takes place shall <br />automatically have any licenses given by the City of Ramsey suspended, pending any <br />process due pursuant to Section 26-26 of the Code of the City of Ramsey. <br />Section 28-839. Penalties. <br />In addition to any suspensions in section 26-838 and any criminal penalties that <br />may apply, the Council shall impose a civil penalty for each violation of this chapter. A <br />minimum civil penalty shall be established by order for the first, second, third or more <br />violations within any three year period. Conviction of a violation in a court of law is not <br />required in order for the council to impose the civil penalty. Nonpayment of the penalty is <br />grounds for suspension or revocation of the license. <br />Section 28-840. Inspections. <br />The licensee shall permit and allow all appropriate city employees and agents, <br />including any peace officer, health officer, city employee, or other person designated by <br />the council to conduct compliance checks, to enter, inspect and search the premises of the <br />licensee during business hours and without a warrant. <br />Sections 26-841-26-849. Reserved. <br />Division 2. License <br />Section 26-850. Licenses Required. <br />Each business offering massage services to the public or for monetary <br />compensation or other consideration must hold a license, as designated in Section 26-851. <br />Each person performing massage services for the public or for monetary compensation or <br />other consideration must hold a license as designated by Section 26-852. No massage <br />services may be performed or offered to the public or for monetary compensation or other <br />consideration without proper licensure. <br />Section 26-851. Massage Establishment Business License Application. <br />(a) Each business or individual intending to offer massage services to the public <br />or for monetary compensation or other consideration must first apply for a license <br />to perform such activities. <br />4 <br />
