PART II <br />Page 13 of 18 <br />Permit No: MN 0060259 <br /> <br />All unauthorized discharges accidental or otherwise, of oil, <br />toxic pollutants or other hazardous substances consistent with <br />Minnesota Statutes Section 115.061 and 40 CFR PART 110 and 116; <br /> <br />b. Effluent limitation violations; <br /> <br />c. A bypass; or <br /> <br />d. An upset. <br /> <br />The 'Permittee shall immediately notify the Commissioner in writing <br />of any occurrences as described in a. through d. above. <br />Notification for bypasses and upsets shall be consistent with the <br />requirements of PART II,A.1. <br /> <br />5. Change in Discharge <br /> <br />All discharges authorized herein shall be consistent with the <br />terms and conditions of this permit. The discharge of any <br />pollutant more frequently than, or at a level in excess of, that <br />identified and authorized by this permit shall constitute a <br />violation of the terms and conditions of this permit. Such a <br />violation may result in the imposition of ¢i.vil or criminal <br />penalties as provided for in Section 309 of the Act, Minnesota <br />Statutes Section 115.07i, and Chapter 609.671 (%988)° <br /> <br />Facility modifications, additions, and/or expansions that <br />increase the plant capacity shall be reported to the <br />Commissioner (Attn: Industrial Section, Water 0uality Division) <br />and this permit may then be modified or reissued to reflect such <br />changes. <br /> <br />Any anticipated change in the facility discharge, including any <br />new or modified industrial discharge or change in the quality of <br />existing industrial discharges to the treatment system that may <br />result in a ney or increased discharge of pollutants shall be <br />reported to the Commissioner (Attn: Industrial Section, Water <br />Ouality Division). Modification to the permit may then be made <br />to reflect any necessary change in permit conditions, including <br />any necessary effluent limitations for any pollutant not <br />identified and limited herein. <br /> <br /> <br />
