CASE # q <br />REQUEST TO REZONE CERTAIN PROPERTY FROM R-1 RURAL <br />RESIDENTIAL TO B-I BUSINESS; <br /> CASE OF BURNSIDE TRAILS DEVELOPMENT COMPANY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On March 31, 1992, Ron Kuhn of Burnside Trails Development Company submitted an <br />application to:rezone PIN 06-32-25-12-0002 from R-1 Rural Residential to B-1 Business to <br />accommodate development of a convenience store on the property. <br /> <br />A public hearihg was scheduled and advertised for May 5, 1992. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br /> Site. location map <br />i Copy of B- 1 Business zoning regulations <br />Exhibit "A" (excerpt from 1980 Comprehensive Plan) <br />:Exhibit "B" (excerpt from 1990 Comprehensive Plan) <br />Proposed findings of fact <br /> <br />Observations: <br /> <br />The subject p~Cel is approximately 10 acres in size and is located in Ramsey's Rural Service Area <br />at the southeaSt comer of the intersection of County Roads #83 and #64. The applicant has <br />indicated that due to poor soils on the property, development of the parcel would be restricted to <br />the northernmost 2-4 acres. <br /> <br />I have enclosed a couple of excerpts from the Comprehensive Plan for your use in determining <br />whether the proposed rezoning is in accordance with the Plan. Item 4 of Exhibit "A" establishes a <br />policy of discouraging individual, free-standing commercial uses. However, Item 6 of Exhibit "A" <br />suggests restricting commercial development in residential areas to convenience type goods and <br />services, which implies recognition of the need for neighborhood convenience facilities. <br /> <br />Exhibit "B" is :an excerpt from the 1990 Comprehensive Plan Amendment regarding development <br />policies in the [Rural service Area. Item 15 of Exhibit "B" clearly states that commercial uses can <br />only be considered in the Rural Service area if they are for the purpose of utilizing or extracting <br />natural resources; or if it is a recreational, educational or institutional use requiring seclusion or <br />natural settingl or if it is a development requiting a large land area for a low intensity land use (i.e., <br />golf courses, shooting ranges, etc.) <br /> <br />Recommendation: <br /> <br />Modify the proposed findings of fact and forward a recommendation to City Council either <br />approve or deny the rezoning request. <br /> <br /> <br />
