Section 9.22.07 of the model ordinance addresses floodway boundary and elevation information to <br />be included in subdivision plans. We have drafted an ordinance to amend Section 9.50.38, <br />Subdivision Design Standards, Flood Plain Requirements. Section 9.50.38 is referenced in <br />9.22.07. <br /> <br />Section 9.22.08 - (Public Utilities, Railroads, Roads and Bridges) - Language was added to <br />require that new or replacement on-site water and sewer systems must be designed to minimize or <br />eliminate infiltration of flood waters into the systems and discharges from the systems into flood <br />waters and that they shall not be subject to contamination during times of flooding. <br /> <br />Section 9.22.09 - (Manufactured Homes and Manufactured Home Parks and Placement of Travel <br />Trailers and Travel Vehicles) - Language was added to require that the placement of new or <br />replacement manufactured homes be properly elevated to the Regulatory Flood Plain Elevation and <br />that sufficient over-the-top or ground anchors be provided. Language was also added to establish <br />under what conditions travel trailers are exempt from the provisions of the ordinance. <br /> <br />Section 9.22.10 - (Administration) - Language has been added to require the applicant to provide <br />registered certification that the building elevations and flood-proofing measures were accomplished <br />in compliance with the ordinance. With regard to variances and conditional use permits, the time <br />frame for reaching decisions has been extended from 45 days to 60 days from the date of public <br />hearing adjournment. <br /> <br />Section 9.22.11 - (Nonconforming Uses) - Language has been added to decrease the status of <br />nonconformity from 12 months to 6 months when the use is discontinued. Language was also <br />added to require that any alteration or addition to a nonconforming structure or use will be <br />protected to the Regulatory Flood Protection Elevation or dry flood proofed. In keeping with the <br />model ordinance, language has been eliminated requiring nonconforming uses and structures to <br />come into conforming with a certain period of time, as determined by City Council, and City <br />Council certification that the nonconforming uses have been flood proofed or otherwise adequately <br />protected. <br /> <br />Section 9.22.12 - (Penalties for Violation) - Language has been added to establish a procedure by <br />which violations of the ordinance should be documented and processeck <br /> <br />Section 9.22.13 ~ (Amendments) - Basically, no change to the procedure for making changes to <br />designation of flood plains on zoning map. <br /> <br />Recommendation: <br /> <br />City Staff recommends that the ordinance be moved up to City Council for adoption. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt the proposed ordinance amending Sections 9.22 and <br />9.50.38 of the Ramsey City Code. <br /> <br />Review Checklist: <br /> <br />P&Z: 5/5/92 <br /> <br />City Engineer <br />Zoning Administrator <br /> <br /> <br />
