§ 9.03 A minis/ratlon <br /> <br />The Board of Adjustment and Appeals shall make its decision by <br />adopting a resolution stating findings of fact and the decision <br />within 60 days of the date the appeal was fi]ed with the City. <br /> <br /> Sub& K Appeals from the Board of Adjustment -nd Appeals: Any <br />person or persons or any board, taxpayer, department, board or bureau of the City <br />aggrieved by any decision of the Board of Adjustment and Appeals, shah have the <br />right to seek review within 30 days of the decision with a court of record of such <br />decision in the manner provided by the laws of the State of Minnesota, and <br />particularly Minnesota Statutes, Chapter 462 as such statute may be from time to <br />time amended, supplemented or replaced. <br /> <br />9.03.08 Application. Where the conditions imposed by any provisions of this <br />chapter are either more or less restrictive than comparable conditions imposed by <br />any other regulation, the regulations which impose the higher standard or <br />requirements shall prevail. From and after the effective date of this chapter, the <br />use of all land and every building or portion of a building erected, altered in height <br />and area, added to, or relocated, and every use within a building or use accessory <br />thereto, in the City of Ramsey shall be in conformity with the provisions of this <br />chapter. <br /> <br />9.03.09 Compliance. No structure shall be located, erected, constructed, <br />reconstructed, moved, altered, converted or enlarged, nor shall any structure or <br />land be used or be designed to be used except and after the lawful issuance of all <br />permits required by this chapter. <br /> <br />9.03.10 Uses not provided for wiflxin zoning districts. Whenever in any zoning <br />district a use is neither specifically permitted or denied, the use shall be considered <br />prohibited unless a conditional use permit is applied for and granted. In such <br />case, the City Council or the Planning Commission, on their own initiative or upon <br />request, may conduct a study to determine if the use is acceptable and the <br />deterr~ination as to conditions and standards relating to development of the use. <br />The City Council, Planning Commission or property owner, upon receipt of the <br />s~aff report shall, if appropriate, initiate an amendment to the Zoning Chapter to <br />provide for the particular use under consideration or shall find that the use is not <br />compatible for development within the zoning district. <br /> <br />9.03.11 Non-Conforming B~,ilcllnB's, Struc~ and Uses. <br /> <br /> Subdivision 1. Intent: It is the purpose of this section to provide for the <br />regulation of non-conforming buildings, s%ruc%ures and uses and to specie' those <br />requiremen%s, circumstances and conditions under which non-conforming <br />buildings, s%ructures and uses will be operated and maintained. This Chapter <br />establishes separate districts, each of which is an appropria%e area for the location <br />of uses which are allowed in that district. It is necessaQ' and consis%ent ~-ith the <br />es%abtisbment of these districts that non-conform{ng buildings, structures and <br />uses not be allowed %o continue ~ithou~ restriction.
