in interest to such person under said mortgage or any <br />right~ arising therefrom. <br /> <br />"GOverning Documents" shall mean and refer to '-his <br />DeClaration, and the Articles of Incorporation and <br />Bylaws of the Association, as amended from time to time, <br />al~ of which shall govern the use and operation of the <br />Property. <br /> <br />"Lo=" shall mean and refer to any platted plot of <br />la~d, upon which a House and or commercial/industrial <br />structure is located, as shown upon any recorded plat of <br />the Property, excluding the Common Property. <br /> <br />"Member" shall mean and refer to members of the <br />Association as described in this Declara~icn and the <br />Bylaws of ~he Association. <br /> <br />"Owner" shall mean and refer to the holder of the fee <br />simple absolute, a contract vendee or a life tenant, <br />whether, one or more persons or entities, of a house and <br />or commercial/industrial structure, and shall exclude <br />holders of an interest as security for an obligation <br />until such Time as they may ob=aim fee simple interest <br />by foreclosure or deed in lieu of foreclosure. <br /> <br />"Private Yard Area" shall mean and refer to that <br />pot:ion of a Lot not covered by a living unit or by a <br />common driveway or commercial/industrial area. <br /> <br />"Property" shall mean and refer collectively to al! of <br />the real property submitted to the covenants and <br />restrictions of this Declaration and legally described <br />in aT=ached Exhibit <br /> <br />me <br /> <br />"Rules and Regulations" shall mean and refer to the <br />Rules and Regulations of the Association as approved <br />from time to time by the Association pursuant to Section <br />5.3. <br /> <br />"House" shall mean and refer to any portion of a <br />building located on a Lot and designed and intended for <br />u~e and occupancy as a residence by a part of or within <br />s~ch building. <br /> <br />"Site Plan" shall mean the documentation and review <br />orocess for commercial industrial uses as required by <br />:he City of Ramsey in its Zoning Chapter of the City <br />Code. <br /> <br />ARTICLE II <br /> <br /> PROPERTY SUBJECT TO THIS DECLARATION <br /> <br />Sec:iOn 2.1 Prooertv.
