Case g2: <br /> <br />,Review Criteria For Approving An Applicant For An Off-Sale Liquor <br />: License: <br /> <br />Council reviewed ordinance #88-241 establishing criteria for the issuance of off-sale liquor <br />licenses. <br /> <br />Council consensus is that the criteria should be mended to delete the requirement that thc facility <br />not be locatedl within 2,000 feet of another off-sale hquor establishment and require a minimum <br />facility size of;4,000 square feet consisting of display area and/or private storage area. <br /> <br />Case #3: Review Off-Sale Liquor Ordinance: <br /> <br />Council reviewed the proposed Off-Sale Liquor Ordinance. Council agreed that the number of off- <br />sale licenses available for issuance should remain at 3; the area of eligibility for the 3rd off-sale <br />license should be the Urban Area; the defin/tion of new construction should be 'never before <br />having been occupied'. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich to reintroduced the <br />proposed Off-Sale Liquor License Ordinance with the following amendments: <br /> <br />The minimum facihty size will remain at 4,000 square feet but no language will be included <br />mandating how that space is distributed for merchandise display and private storage. <br /> <br />The requirement for not locating an off-sale facility within 2,000 feet of another off-sale <br />facility should be deleted. <br /> <br />Further, that the Ordinance will be presented to City Council for adoption at the next regular <br />meeting. <br /> <br />Motion carriod. Voting Yes: Mayor Reimann. Councilmembers DeLuca, Pearson, Cich and <br />Peterson. Voting No: None. <br /> <br />Case #4: 'Countryside Estates Area Park Acquisition: <br /> <br />Mr. Goodrich recalled that on March 2, 1989, Council authorized staff to pursue acquisition of <br />park land in Re area of Countryside Estates. One of the parcels under consideration was Lot 9, <br />Block 2, Windsorwood Addition. since that time,the property is listed for sale at $10,500; staff <br />thought it prudent to enter into a purchase agreement for the purchase of the lot subject to Council <br />approval. The residents of Countryside estates prefer that the park lot be replaced by a lot to the <br />south that is o, wned by Mr. Otto Sundberg. Those residents are concerned that the City will lose <br />interest in pursuing that lot if the lot in Windsorwood is purchased. Mr. Goodrich advised Council <br />to approve the purchase of the lot in Windsorwood in the event the City is unable to acquire the lot <br />owned by Mr. Otto Sundberg. If the City does acquire one of Mr. Sundberg's lots, the City could <br />sell the lot in Windsorwood. <br /> <br />Motion by cotmcilmember Cich and seconded by Councilmember DeLuca to afl.rrm the Purchase <br />Agreement signed by the City Administrator for the purchase of Lot 9, Block 2. Windsorwood <br />Addition, at aprice not to exceed $10,500 and on such additional terms as staff deems advisable, <br />and to therefore authorize removal of the City Council approve contingency from said Purchase <br />Agreement. <br /> <br />Motion carried.
